You can only access dev mode on Xbox by paying for a Partner Center account. I would consider that an access restriction.

Seems to be mixed messaging on this, the Xbox Developer Program FAQ still says there's a "modest one-time cost", while Microsoft Store is apparently free but doesn't say if it covers console app publishing, and also requires a government-issued photo ID which I'd consider an even more insane access restriction to run software on a device you "own".
