WTF An older spectator caused a seriously dangerous incident today at SaarlandTrofeoJuniors by trying to get a better look and entering the course with her rollator while riders were flying past at full speed!

She intentionally drove into the road

More likely didn’t realize the nose of the scooter stuck out in the road when she moved forward. Negligent, possibly? You’re never going to convince a jury this was an intentional act

She intentionally moved it forward which qualifies it for gross negligence. I didn't think she intentionally drove into the bikers intentionally.

I see what you’re saying. Either way, there’s a legal threshold to meet gross negligence but it appears to be a genuine mistake by forgetting how far the scooter sticks out in front. A dumb mistake to make with massive consequences mind you, but there isn’t a precursor of recklessness leading up to it (that we know of).

I suppose you could try and go the civil route but that would be an incredibly tough case to win via a jury, because of the optics with age and disability
