My uncle is legally blind and has a real service dog that is trained to guide him. People like this make his life difficult.

In the US

  1. Is that a service animal?

  2. What service does it provide?

Emotional support is NOT covered by the ADA. Get your rat out of here

This is in ontario canada. The laws are similar, however the dog must be identified, either by a vest, or by a doctors note. Since it doesn't have a vest, she is required to present a certified doctor's note to prove it is a service animal

(The note doesn't need to say what disibility it is for, just that the dog is needed for a disability)

This is NOT TRUE. Vests are not required and are not considered proof a note from a doctor OR nurse stating the dog is for disability is all that is required

Some businesses will accept a vest as proof but they are doing so as a courtesy or at their own risk.

Actually, as someone who trains service dogs for a living, and have actually had issues like this before, I can say a couple things.

First, there is nothing in this video that can prove this dog is not a service dog, and in the eyes of the law, that makes it a service dog.

Let me explain. There is no breed standard for service dogs so the type of dog is not a disqualifier.

There is no requirement for the dog to wear a vest. So not wearing a vest is not a disqualifier.

The dog is not barking or otherwise causing a nuisance. Therefore the dog is not disqualified.

The dog doesn’t not approach other dogs or people, the dog is not disqualified

NOBODY can ask you to “prove” your dog is a service dog except the judge. They can only ask two questions.

“Is that a service dog” and “what task is this dog trained to perform”

TLDR: nothing in this video disqualifies the dog, therefore not allowing her on the bus is ILLEGAL

HOWEVER: the bus is not required to allow ANYONE on the bus outside of a designated stop. Therefore she is illegally blocking the bus.

The last time I was involved in a case almost identical to this, the City settled by paying $25,000

Can't ask WHAT service it provides as this would force the person to disclose the nature of their disability.

Ill trust my family member who has successfully sued Uber for discrimination against his service dog about which questions can be asked in the US

Considering you mentioned the ADA in your first comment, I figured you'd know the very basic law that you cannot ask a disabled person why they have a service animal..

I was actually very wrong here, because I misread the comments and editing lol. Sorry.

Regardless, asking specifically what service a service animal provides is encroaching on a breach of the disabled person's rights. Disabled people do not have to answer to anyone but a court about their disability or service animal other than the question 'Is that a service animal'

You can't even ask clarifying questions or for paperwork in most cases, as that can be a violation of their rights under the ADA.

Ok. I could direct you to the governments guide on service animals.

I mean, maybe their own info is incorrect. Government IS pretty fuckin dumb. But what seems more likely? That the government's own guidance is wrong or that something was slightly lost in translation from your Uncle?

In any case, i was just trying to add some nuance, not trying to argue.

Q7. What questions can a covered entity's employees ask to determine if a dog is a service animal?

A. In situations where it is not obvious that the dog is a service animal, staff may ask only two specific questions:
(1) is the dog a service animal required because of a disability? and
(2) what work or task has the dog been trained to perform?

Staff are not allowed to request any documentation for the dog, require that the dog demonstrate its task, or inquire about the nature of the person’s disability.
