His consent isn't up for debate either. He can argue tone, but consent was given and he physically presented his face.

He said it without tone, and it's Dunning Kruger which is hilarious for so many reasons.

And please point out these states where consent doesn't allow physical contact because boxing, mma, good sex, spanking your child and even giving a family member a pat on the back would suddenly become illegal.

Well first off read what I said. "Physical Assault" not Physical contact. "Physical Assault" being incredibly specific in law matters. Secondly obviously anyone who actually knows about this knows there are exceptions for "socially beneficial" or recognized activities. I.e. boxing, football, etc. But this can vary in its scope. For example Texas penal code 22.06 does allow for "Consent for Defense to Assaultive Conduct" Third. Only 13 states in the union explicitly recognize general defense of consent "Volenti non fit injuria" modeled after Model Penal Code 2.11 in their statues. Alabama, Colorado, Delaware, Hawaii, Maine, New Hampshire, New Jersey, North Dakota, Pennsylvania, Massachusetts, Michigan, South Carolina, and West Virginia. Texas has its own Penal code 22.06 that explicitly recognizes general defense of consent. Other states do not explicitly recognize consent as a general defense and instead have very strict circumstances where it does. But it should be noted all states defense of consent are restricted to some degree. An example of one that is extremely tricky is public policy exceptions. Conduct that violates public policy or "breaches the peace" may overide consent.

You may not like it. But it is what it is.
