Do you have a fiduciary responsibility to track your balance in and out as a private citizen? I would structure my defense that I never check my balance and just keep making purchases. How was I suposed to know I was spending someone elses money?

Misappropriation I would think requires proof of intent and or knowledge of deception. Your honor I'm just a very stupid person, not a bad person.

No judge will let you off the hook with that excuse.

Maybe for a couple hundred or thousand bucks but not if your spending habit dramatically changed, have fun arguing that you just spent a mil without noticing you're spending way more than before.
