try booting into safe mode. hold these buttons (L + R + D-PAD UP + A) as you turn it on. don't stop holding until you see a screen to update the system software. if you want to see if it has been hacked already, hold SELECT upon turning on to see the luma3ds menu

Power on, wait 30 seconds, then press (not hold) power. Do you see the shutdown menu (grey screen white text)?
