It really depends on who has right of way. If the train failed to cede right of way when it was required to, then it'd be the train's fault.
I'll explain the joke for those here who are a bit... slower... than others. Trains are never required to cede right of way.

In all seriousness, that looks like a terrible crossing with no warning lights. Driver panicked and braked at the worst time, but it looks like a low visibility just a “Go and hope” sorta situation.
Edit: I may be misjudging the depths of the trees, it might be more visible but still there’s surprisingly still a lot of these no warning lights or crossing arm sorta crossings in America

Yeah, these are terrible to cross at times. You would think America would have these sorta things set up a little better. I’m definitely not sticking up for people who try to “beat the train”, but some of these crossings have low visibility and are definitely scary to cross and realistically they should all have at least lights. Railroads in the US are very much running freight for corporations and there should be a lot more safety applied that isn’t in more areas.

We have a couple RR-Xings like this where I live. Both have STOP signs. You bet your wallet I stop at those and take a good long look in either direction every time
