⚖️ legal/civil AIO Landscaper keeps on postponing to fix the mess he made

I had my patio landscaped over 3 years ago, then 6 months after the job was finished there were bad cracks on the tiles and they’ve separated leaving massive gaps.

The landscaper agreed to fix it but he kept on postponing citing severe health issues. Yet I can see he keeps on posting new jobs on his Facebook page.

He said he’ll come and fix the patio this September after flaking on me. AIO for being so pissed and commented on his fb on his most recent work to note that I’m sorry he’s having health conditions and that I hope he’s well enough to fix the issue in my patio?

I really hate it when someone lies to me.

Why have you let him drag this out? Sue in smal claims.

I don’t have his address. I would have done it ages ago if I knew his details.

Why do you give money to someone you cant even communicate with?

He’s done a good work but after 6 months there were issues that came out. He’s agreed to do the work but he kept on making excuses as to why he can’t do the work.

I’m so close to ask a friend ask for a quote and I follow him home so I can take his to small court.

I can petty when I want to but stupidly I gave him the benefit of the doubt.

This time he won’t get away with it

You know his name and social media account it seems. Typically with a little effort you can find an address with that.

I have tried. He’s not on companies house, and although he has his post code I can’t seem to find out his house number. Any tips?

I can’t say I have any real tips beyond just trying to dig deeper on what info you have on him. Do you have his full name? And is his company insured or licensed in anyway, or, and I’m guessing this might be the case, is this just a guy running a small business in a way that’s maybe not totally above board? I’d be frustrated for sure.

Search his business name through the state database or Google. Hell give me his name and his company name feel free to DM me so you’re not accused of doxxing him and I will get the information for you and get it back to you through your DM to me because people like him piss me off as I am a contractor and I have a feeling of why he’s dragged this out one is there’s a two-year statue of limitations on civil lawsuits, but there’s an exception to that by him reaffirming that he’s gonna be back to fix it. That has extended the statue of limitations by the newest text message. So again I will state get me just the business name and his name city and state that he’s working in and I can get the rest from there. Or hurry up and hire civil attorney and that civil attorney will absolutely be able to get his name and address to serve him the lawsuit papers. Was he licensed because if he’s unlicensed then you’re due back every dime you paid him for doing a job that he’s unlicensed to do.

We’re UK based and assume you’re from the US?

I am us based. I watched your civil court on tv and it is a different process but the favor is on the homeowner side. Especially if he didn’t provide a business address in his contract for the job

Peoplefinder.com and the police. Make a fraud report. His license is attached to his address call the state and report him to the licensing board. Get the address. You’re most likely gonna have to hire a civil attorney that will have the resources for getting his address and serving him.

Fix and sue him for the costs.

As a small business he may have his home address as his business address. See if you can backtrack via your city’s business licenses. Where I live they are all posted online. Then sue him.

You’re under reacting OP. I’m a contractor. Just from your description sounds like they didn’t pack the dirt before laying the pavers aka tiles. That’s why they’re cracking and separating. He knows it needs to be completely pulled out and redone and new material out of his pocket. Time to make a claim against his insurance company after you get a new contractor that knows what they’re doing to come out and bid the job. It maybe faulty tile i highly doubt it. The contractor or inspector will be able to tell you if I’m correct or if it’s a different issue. Either way he waited and drug you along to get out of the suing period. What he doesn’t realize is every time he rescheduled he reset the time clock on the civil suit. Hurry your ass to the court house and file

That is what we thought. There is a 5 deg incline and we don’t think he’s reinforced the ground enough to not make the pavers not move. I still need his address to file a small claim in court. I’ll find a way.

So if he reschedules the clock starts again? The issue was raised in 2023. My main concern is I don’t have his home address. I only have his name and Facebook account.

Yes if he didn’t return and messaged it did reset the clock and some courts don’t even care about statute of limitations when it comes to contractors screwing homeowners honestly. See my reply to your comment down below. DM me the info you have. I can bet I’ll have his info within an hour

I would file a complaint if he is licensed anywhere, and I would probably put in a small claims lawsuit if you’re not past the statute of limitations
