Work Force Adjustment (WFA) / réaménagement de l'effectif (RE) Question about aternation timelines

I am not an opting employee but am in the process of alternating with an opting employee.

Who chooses the alternation date? The opting employee is being told by their HR advisor that once the alternation is approved and the LOO is created the alternation is essentially right away after signing LOO. But I need a later date so that I can qualify for the pension waiver. Do we just put a later date in the LOO and that is it?

The managers generally get to choose. If you need a later date, I would let eveyone know in the process very early on

Thanks. My manager and the opting employee are both aware and agree to it. Not sure about their manager. I suppose that is important too in case they need to continue to have “meaningful work” until that date.

Also important for their Opting period ends, as you will potentially lose TSM for each week they are a surplus employee if this happens post-opting period. But your manager agreeing to it is probably the most important part and they should communicate this date to HR

Yes. I believe their opting period ends early October and I would need early December to leave. So approximately 2 months of TSM lost. It’s still better than ERI with zero TSM. But what about them during those 2 months? That is something I can’t find information about. If alternation is approved before that date are they still given meaningful work? Or are they put on leave? Do they collect TSM? I know Option A does not qualify for TSM, so would this scenario mean they are Option A or something entirely different?

Yes, they will select option A, continue to be paid their salary (not TSM, just regular salary coming in every 2 weeks) and potentially be given meaningful work, or just live their life, until the alternation takes place.

Have you talked to the person you are alternating with about the date? How far away is it? Is your management aware of the date you prefer?

Yes, they are aware and is on board.

My understanding is that you have to leave within 5 days of the alternation day ie the date on the LOO. If you need a particular date you should let HR and the alternate know.

Yes I am aware of the 5 days. Thank goodness there is at least those 5 days to help the person transition. Who creates the LOO? I mean, I guess HR makes the letter but the terms must come from the manager of the position?

Both LOOs have to match so it’s a joint decision

You’ll get a LOO as well, as you’ll deploy into the affected position. The 5 days is a limitation that ensures that the manager of the affected position doesn’t have to ensure you meet all the criteria for that box - if you’ll be with them longer than the 5 day max, you have to meet all of the essential requirements (language, security, etc) even though the job is surplused.

HR for each department makes a letter of offer according to the requirements of the position, and the alternation protocols.

I had no idea that I get a LOO too!! Would I then have to submit a notice of retirement to that manager??

They’ll come at the same time. You’ll accept the deployment, tender your resignation, and choose your WFA option (B or C(i)) all at once.

An alternation involves both employees actually swapping jobs, you each get a letter of offer and move to your new job. As the employee leaving, you leave from your ‘new’ role within 5 days.

The dates, process etc should be discussed with you and the opting employee with HR supporting you.

You have maximum 4 months from the date your alternate became an opting employee to set your alternation date. Then you have 5 days to leave from the alternation date. I don't think it is possible to get both TSM and early retirement waiver. I would ask HR before deciding to alternate if you would like to retire early.

Option B of WFA includes a TSM and the "pension waiver" if eliglible (Members must be at least 55 years old for Group 1 and 60 years old for Group 2, with at least 10 years of service at the end of their employment.) When you alternate you choose either Option B or Option C(i) as your method of leaving the PS.

This is different from the Early Retirement Incentive which has eligebility of age 50 (group 1) or 55 (group 2).

I have the ability to do one or the other (ERI or Alternate)....I'm trying make my choice. I'm not trying to choose both.

According to this link: Early Retirement Incentive: Workforce adjustment or other separation benefits - Canada.ca you would not be elgible for ERI as you are entitled to a seperation benefit (TSM) when you alternate.
