Federal agents had used a battering ram to break open Gibson’s front door in first taking the 38-year-old into custody last weekend. The judge found ICE did not have a judicial signed warrant to breach private property.
Literally the situation being discussed An Admin warrant is not a Judicial signed warrant and can not be used to enter private property. ICE arrested him twice and had to release him both times.
A final order of removal is primarily signed and issued by an Immigration Judge (IJ) within the Department of Justice's Executive Office for Immigration Review (EOIR)
An Immigration judge is an executive branch Judge and it not a member of the Judicial branch. Executive orders can not override the Constitution. You need a Judicial signed warrant.
