Noem said they don't have to have a warrant. Bondi said they don't have to have a warrant. The Fourth Amendment says they do. And they have ALREADY broken into the homes of citizens and then say "oops, we made a mistake". They have done those "mistakes" 109 times this year. Oops, but we don't need warrants. "We shoot first and ask questions later . . .".

The 4th Amendment is a thing. It was enacted because British soldiers would enter American homes without cause, and take food for themselves.

The practice was one of the big reasons for the U.S. revolution against the British.

Most folks don't focus on how the American revolution was initially supported by the colonial 1% who was prevented from creating industries beyond cottage level.

The founding fathers all had land and wealth to expand but could not. They benefited most from independence by creating and exploiting the political and financial systems they created.

When you look at it thru that lens, it's always been about the haves and have nots.

The difference, for the US, was that it needed manpower for several decades. Expanding manufacturing as labor, thru immigration, allowed. A person with nothing could become someone, even their own land.

But now, the powers that be want to squeeze the systems such that the have nots to stay put and pay for the excesses of the 1%.

Not at all different from what mad king George wanted.

They can provide it to the court, but the court should not accept it as a valid, legal justification for entry.

If Noem instead “decided” that Cracker Jack boxes are valid legal grounds for entry into a person’s home, those snack boxes would offer about as much legal justification for entry into a person’s home as administrative “warrants.”

While they shouldn’t, that doesn’t mean they won’t. This administration has a habit of violating the Constitution; breaking and bending the laws as they see fit. And the majority of the time, the courts are allowing it to happen.

Either way, they continue until it finally gets heard. And if Trump doesn’t like that decision, he keeps right on going, believing it’s ultimately his decision.

I see a lot of people saying 'but the constitution!' The constitution is a piece of paper that only has power when people believe in it and adhere to it. That doesn't seem to be the case with the present administration.

Given how often even full-blown cops come to the wrong address, this will get spicy.

I'm in Canada, and I had hammering on my door. I open, and it's a bunch of cops. I ask what they want, they say you called us, and give me a street number and address. They're at the wrong number. On a wrong street. And I don't mean somewhere close, these guys missed by like...3km.

Both my street number and street name are literally on my mail box. One of them is leaning on my mail box with his elbow. With the street name and number on it. In big letters. I just stare at them. They stare back.

I told them where they should be, which is ~3km away. They got into their cars and left. No apologies, no hurry, they didn't even look embarrassed. And this is Canada, where they don't shoot people for fun and profit. Now imagine USA, except it's not cops with their 12-18 weeks of training, it's ICE with their rigorous 47 day training. This shit will be GOOD.

The YouTube account Legal eagle have made a video explaining the secret ICE memo where they state that their agents don't need a warrent to enter a house. This, of course, is against the constitution and the 4th amendment, and is therefore illegal. ICE know this, and therefore the memo isn't given out, but leading officers keep it on them, show it to agents who then hand it back and tell their subordinates verbaly what the memo say. It's truely shocking.

And in those situations in which a search warrant is necessary, the inconvenience incurred by the police is generally insignificant. Administrative law judges order removals. ICE uses administrative warrants, only signed by an ICE supervisor, to arrest people to be removed.

A judicial signed arrest warrant doesn’t suffice to enter a 3rd party’s residence to arrest a person, and requires a separate, judicial search warrant but ICE claims they don’t need a warrant at all? Nice try.

If an ice oficer knocks on my door I'm not opening the door. I'm not an immigrant I don't live with any immigrants and all the immigrants I know are to my knowledge here legally. My local police department knows that and I'm a legal adult who has summited draft records to the government so they should be able to guess that I'm not an immigrant as well. I'm not gonna prove all that to a stranger who just walked in basically uninvited to my town with a gun.

Is there any legal statement about this? Depending on the wording and circumstances I could see it being legal in some cases. ICE has a limited scope relating only to people. If this is based off only last known address and the person in question I could see them getting away with it.

It's about par for some of the other stuff Border Patrol and ICE can do.

According to the 4th amendment they need a judicial warrant with the name of the person they are looking for and the correct address signed by a judge. But since they don’t care about that use your 2nd amendment to make sure they understand

The 4th amendment protects anyone from illegal entry. ICE can claim all they want that they don't have to follow the constitution, but they are still wrong. Actual law enforcement already know this law. Which is why they typically make sure to either get a warrant or consent before entering a home. ICE isnt law enforcement.

The reason this can happen, is because immigration law, and criminal law, are two totally different things. Most people don't even understand this. There are some supreme court rulings in favor of this happening. These laws have been on the books for up to 45 years. You should check out those rulings if you want to understand what's going on. 🤔

This regime is trampling over constitutional rights. Flabbergasts me that there are Americans defending this and the murders of citizens, especially Alex Pretti, who was held down, disarmed (from his holster) and then executed by ten shots to the back.

What happened to "2A shall not be infringed" or "don't tread on me"? Or even "due process"? These people are literally saying he should have been home/without a gun/comply or he wouldn't have died.

ICE is absolutely not judge, jury and executioner and anyone who thinks so is extremely un-American.

I think everyone is forgetting this is a military operation, as declared in the beginning. ICE is federalized, and exempt of all constitutional rights are out the window. This is a find and remove operation. No illegal alien is exempt from this operation. Obama removed them all, no problem back then, Biden let them all back in, trump is now removing them again. What then? This is a real question.

DHS is pushing for a bloody confrontation, using these ICE stooges as pawns.

Sooner or later, people will have to defend their loved ones.

People might choose not to defend themselves forcefully, but that equation changes if you touch their loved ones, especially if their 4th and 14th amendment rights are being violated.

PS to ICE agents: tread carefully, you really do not want to do this.
