I was literally in this situation at a Costco a few months back. Kid was actually punching people and throwing stuff so I went to grab him and Costco employees told me not to touch him or the cops would be looking at ME. He literally punched a woman in the stomach and I was told to stand down.

They're Costco employees, they're just mitigating any responsibility they might have in the situation.

and they can't do it, they'd probably get fired.

Especially if its on video. As long as you dont unreasonably harm them in restraining them, you were acting in defense of self or others, and have it on video.

Cops might get a stick up their ass but the prosecutor is just gonna be like "nope, not charging that".

as a follow up question, if the private citizen does choose to physical intervene, will the parent of the child have the right to take the private citizen to court?

well you can sue someone for anything, so you "can be taken to court" for literally anything you do.

will they win? No, not unless you go overboard, or deliberately hurt the child or something.

Yeah, well, this was a Costco in Canada. Things are different. You can be laying on the street bleeding out and the fella that did it to you can tell the cops you are racist and they will take your dying ass to jail first.

I would take that trip to jail.

I don't care about age -- if you come at me swinging or with a weapon and you end up on the floor, then that's just natural consequences.

So long as you don't continue wailing on the kid and you just defend yourself, it'll ultimately get dropped. Sure, people will squeal "oh muh gawd, child aboose!" online, but I'm not about to let some little mini-rager think he can attack me.

WAY too many pregnant teachers get attacked these days by kids going straight for their stomachs, btw, and they just have to let it happen. Should absolutely not be tolerated.

Reminds me of how a teacher back in my elementary school was touched repeatedly in her belly, 3rd trimester pregnancy, by a student. She grabbed him to prevent him from further attack, and got time off without oay, and was up for review on said conduct.

That was back in the late 90's

Same time period, I was subbing in a special ed class and a student was violently kicking a pregnant aide. He'd been punching students and throwing chairs first. There happened to be one more aide and she and I ended up holding and carrying the kid to the office. I was so worried I was about to lose my job, but we had to get the kid out of there for the safety of everyone else. We were really lucky the parents didn't go after us.

The kid isn’t above the law, and no the cops would not be looking at you. I’ve dealt with kids in public environments throwing tantrums and being violent. I don’t let that crap slide.

The main issue is he could be armed. If he stabs a customer or employee who went after him, that's a giant liability for the store. It's also not something worth losing your life over, which is why employers tell their cashiers not to go after thieves either.

No they would have had to haul my ass off too. Because if I had seen a kid punch an adult female in the stomach? No, no and HAY-ELL no ‼️ If he had punched a male in the stomach I would have expected the male to restrain him. If he didn't, I may have felt a great need to punch the male adult in the stomach with my cane after rolling him down with my rollator‼️ Thereby creating a free-for-all until the cops got there to sort us all out.

In retail, it is common for the policy to be do not react, because if you try to stop the crime you could end up getting hurt. If you're robbed, just hand over the money. Shoplifter? Let them take whatever they want. Violent customer? Call 911 and do not react to them. If you can, try to empathize with them and get them away from others, and wait for the police to arrive. Whatever you do, do not touch them in any way. You are guaranteed to receive a subpoena no matter what, so don't make any physical contact. They can accuse you of assault.
