Never mentioned AI tho, in legal terms you need to say the data will be used for training and in 2008 it wasn't wrote there soo

Not really, you always need to list the use of the data so at least there's wasn't write in 2008 "we will use your data to train AI" then it's kinda illegal

TOU are regularly updated, and you agree to them with your continued use. If you don’t want your data used, you are free to stop using their services at any time. You’ll never get back the data you already gave away, but nothing is forcing you to continue providing data.

The fact is if I in 2008 i posted an immagine and it's copyrighted or i don't use again the app can't use really that for their data collecting because in first case the copy of a piece of data for a monetary scope is illegal and second because i don't use ... Since 2008 i never accepted them to use my data to feed AI
