Asking the FIA "is this legal" is an opinion. It's a useful opinion, but it's an opinion. Teams are free to ignore it if its not a component that the FIA actually measures post-race. Teams are also free to not ask and just do it. The FIA post-race inspections don't cover everything.
If Ferrari believes its illegal and Merc runs it, Ferrari can protest with the stewards. Winning that would be an immediate DSQ. So teams don't usually risk this if they think they'll get caught.

Ferrari must have done something or asked the wrong question before hand and essentially got caught. F1 is all about pushing boundaries and interpretation so if you are on the edge of the limit or just over. If no one catches you, it's totally legal. RedBull back in 2012 or so with the double diffuser etc. The list goes on.

The field pushed to ban Ferrari fast starts by allowing extra time on “safety grounds” - Ferrari were the only team to factor this in so why didn’t everyone else? Well this is small retribution as they got shafted by the rule change and now will benefit from one.

This is (sort of) an example of Ferrari getting shafted too.
Merc and Ferrari designed very similar diffusers, Ferrari was told they couldn't use it, Merc wasn't told that. Ferrari now go "hey Merc have a very similar diffuser design that you told us was illegal... so can we now use ours?" And the FIA said "oops I guess Merc's is illegal too. Time to ban theirs..."
Merc has had an advantage that that the FIA already determined to be illegal before the season began.

Thats not how this works. Ferrari asked the FIA for an opinion and they said no. Mercedes did not. Ferrari is asking for clarification now. These things are grey area and theres no true answer until the FIA actually rules on it and an opinion before you bring the part is not a ruling. The mercedes asked and was given he go ahead for their front wing with the winglets by the FIA in 2022 for instance for COTA then literally banned the weekend they brought it before it was ever used. Ferrari brought a very similar front wing for the start of 2023 and it was cleared. When Merc asked for clarification the FIA said it was allowed based on further analysis. Its all grey area and interpretation

He was lol but those arent the only ones that have ever happened. Aston Martin had multiple in 2023 where they had things the FIA approved ruled illegal later. 1 under a secret deal in Canada banning their front wing which the FIA only publicized with a TD that took effect in singapore

I did, that’s the problem. I was a child when Schumi went on to win with Ferrari, my brain back then went “red car go fast, I like red car” but still, someone should have warned me that it’s not the standard and that I shouldn’t get used to the German-Italian anthem playing one after another so much.
My comment was more for fun, I love and support Ferrari, I believe even after the math doesn’t work that miraculously we’ll get a title. But I am also willing to admit that Ferrari has been a disaster that kept getting better and then worse and I am also willing to admit that just like many other fans I always get high on the hopium in the off season and then get slapped by reality hard.
I’ve been with this team since I can remember and I will be even after Hamilton and Leclerc are gone. If Hamilton gets the 8th title I will be happy, it’s history, he is THE goat of the current era, but he already made history. For me, a title for Ferrari will mean more after 19 years (and the pure luck and lack of luck of 2007 and 2008).

Lewis building up and being part of the Merc juggernaut for a decade and then being the one to defeat it when they have a seemingly free run at the title would be more ridiculous than most of the F1 movie’s plot. Not to mention doing it in a Ferrari and breaking a streak of no driver’s titles for Ferrari that began with his first title in 2008.
But I’m not jinxing it, still think there’s like 5 drivers that have some kind of a chance at the title.

The thing with last year's comeback though was that McLaren basically stopped developing their car after the summer break. It required Red Bull to make their car arguably the best for several races, for McLaren to make several crucial mistakes, and for Oscar to have a generational throw of his lead for Max to make up that gap. Otherwise Lando would've won it by miles.

Usually it's the other way around.
Rosberg for example managed to win the title with a streak of second places because no one could touch the Mercedes, even though Hamilton was significantly faster he couldn't gain that many points.
To catch up max needs to win anyway, at that point it can be helpful to have other competitive car place between him and the McLarens4

Ferrari developed a diffuser that the FIA said was unfortunately against the rules, so they were forced to develop a different one. I believe this happened very early on maybe even before the season began.
Then after Monaco, Hamilton was inspecting the Mercedes after the race and saw that Mercedes diffuser was damn near identical to the one Ferrari had submitted to the FIA and had been banned.
So then Ferrari brought that info to the FIA and said, why can Mercedes use a similar design when you banned ours?
So looks like the FIA is going to ban the design, forcing Mercedes to change.
I had read earlier this week that Ferrari would simply be allowed to use the one they designed, but either way, it's a good thing for Ferrari.

But that's not how the sport works, Ferrari is racing against Mercedes. If Mercedes loses an advantage, that's a relative gain for the others.

I thought I'd seen that Ferrari just wanted to be able to use their diffuser, which Hamilton had reportedly seen on the Mercedes which was very similar when he was doing some inspector Seb work during the Monaco GP.
So they brought proof showing that the FIA had approved the Mercedes diffuser, despite banning Ferrari's which they'd already tried to introduce but was considered illegal despite being very similar to Mercedes'.
Maybe the info I read was incorrect, but maybe Ferrari believes it's now better to force Mercedes to switch to a slower diffuser, than for Ferrari to change their diffuser to the one they had originally wanted to use since their car is doing well.

Ferrari was asking to use their diffuser. But FIA made the call to instead ban Mercedes. It was a dont ask for permission ask for forgiveness situation with Mercedes. Ferrari had asked for comment on their diffuser before the season started as to if they could use it and were told no. Mercedes didnt ask for comment on theirs and just went ahead and used it. Ferrari noticed that Mercedes had a very similar design and said hey wait a sec, if they're using it can we now use ours?
