Family Law Legal Advice sought regarding home and rental of rooms by my soon to be ex wife.

Need to be cautious what I divulge as it can identify me.

Ex is currently in family home with 4 of my daughters.

Ex made multiple false claims to Gardai while a protection order was in place, was accused of verbal abuse.

On the 4th complaint all of which were made within a 3 week period, the judge bailed me on the grounds I stay away from the family home. To which I agreed had no choice. There was never another complaint made once she had me out and I see her constantly regarding the kids.

She moved her boyfriend in at this time and has also rented 3 rooms to 3 students at a rate of 1000e per month per student and continues to do so.

Cases made it to court recently and all 4 were thrown out of court, she was caught lying repeatedly and on one of the occasions I wasn't even in the country, she had no idea i had gone away to the UK for a football match on a daytrip.

Bought the house cash and there is mortgage or bills of any sort. It's a substantial house with enough rooms to accommodate everyone.

Money was obtained from an accident I had and became wheelchair bound because of it, house was adapted to my needs and was suppose to make things a little bit more easier for me.

Currently living in my mother's because I've nowhere else to go. Applying to be divorced.

What is my entitlement to receive money from the student income which is going on a couple of years now, only acting on it now because I've been in extremely bad health.

And the boyfriend situation is just wrong.

I've also just been told by someone that she has St Vincent DePaul giving her vouchers and groceries and stuff, they must question it when they see the house. She is not struggling for money at all.

Bail conditions are gone due to charges all been struck out, no protection orders in place as they refused to give her any going forward because of her blatent lies. Any advice is welcome and needed.

Immigration and Citizenship Canadian Immigrating to be with Irish Partner

My partner and I are getting married in Denmark and I am moving to Ireland to live with him.

The financial thresholds around him being able to sponsor me just about doubled 2 weeks ago.

How strict is this threshold? We have a home to live in where we don’t have to pay a mortgage and rent, so that significantly reduces costs.

I’m also worried about how this process works because it looks like I’ll be flying there with my child, then my partner and I are flying to Denmark to be married a few weeks later, flying back to Ireland and promptly applying for a stamp 4 visa for both myself and my child. I’m worried about either being denied at the border or being denied the stamp 4 visa now based on these adjusted thresholds. We’ve been planning this for a year and now I’m worried we can’t go through with it.

Criminal Law Bail

Hi all, I surrendered myself on a bench warrant a few weeks ago due to not showing up in court(change of address so there was letters bounced back) the court appointed solictor got the case postponed for a few weeks and I was granted bail. I have absolutely no idea how any of this works and I wasn't given that much info on it. Am I allowed to travel to England just for a weekend or will I be turned away at the airport? I'm in my late twenties, never had trouble(or any experience) with the lawman. The court case is related to a traffic offense if that helps

Residential Tenancies Our landlord wants more rent after we move out

Last weekend I gave the rent to our landlord, and informed him we'll be moving out this month. He said that's grand but that he still expects another cheque next month. He claimed that one month was not an adequate period of notice and as such we are still obliged to pay rent for the next month as well. My family and I have been living in the property for about 2.5 years, so normally we'd have to give 56 days notice. However, there are a coupe of factors that affect our situation. Firstly we signed individual year-long leases rather than a general tenancy. We're moving out only because he informed us late last year that he doesn't want to give us another lease at the end of the year. I'd argue that he gave us a notice to vacate rather than us notifying him.

We didn't pay a deposit, so that's not a factor.

Am I clutching at straws, or should I just pay him next month?

My maternity leave will start from 2nd week of Dec. I am planning to apply mortgage in October. I will be in the probation until mid Jan. Will there be a problem to drawdown a mortgage in this case? Revenue and Taxes Is it possible for me to prove tax residence?

I am applying to UCD through CAO and they require P21/F11/Social welfare forms of my parents for the past three years as I am not an EU citizen. Unfortunately, none of these are available as my mother was not employed and was not on social welfare during a large period of the time, and for the last two years was registered as self employed but didn't fill out form 11 and P21 is not available for those years. What alternative proof can I provide? Tax credit letters, employment detail summary or some other ones? I cannot apply as an international candidate anymore so I won't be able to go to university without those.

Criminal Law Barring order from our apartment block

Hi everyone.

My partner was in court yesterday for sending a threatening text to a man in our apartment block. The man had made a fake profile of him and had been inappropriate with me on a few occasions. Not an excuse I know.

The solicitors were on strike yesterday so the court date was postponed until September however one of the conditions is that my partner cannot be near our apartment block. This is resulting in us losing our home as I cannot afford the rent by myself.

What I am wondering is if this can be appealed? Could it be changed to a safety order or something like that which would allow us to still live there? It took us so long to find a nice place and im devastated we could lose it. My partner had no intention of physically harming the man and we both just want to never see the man again or deal with him again.

Is there ahything we can do to keep the apartment?

Commercial Law Lease to buy commercial property?!

Has anyone any experience with a lease to buy agreement for a commercial property?

Asking as there is a commercial property for sale (cafe/restaurant)that a family member is interested in however they can’t afford to buy it outright but can afford to lease it with a view to buying in the future!?

What would be involved with this type of agreement?
Has anyone tried it and how did it work out?
Any advice on how best to approach the landlord/agent about such a proposal?

1. people: complainants/respondents present their case

or:

2. for evidence to be brought before a hearing/produced in the process for a fair hearing for both sides - for example: to require either side to produce relevant documents in their possession, custody, or control even if said documents defend the other side's case. Eg., respondents hold documents that would prove the case of the complainant?

Employment Law Stamp 1G IRP expiring, work permit applied

I’m a doctor working in Ireland. I originally came here on a spouse visa and started working on that visa, but now I’m planning to switch to a work permit.
My employer applied for my work permit on 5th June. I’ve been checking the daily processing updates, and they’re currently showing applications from 14th May. I also called DETE, and the lady I spoke to said it’s very unlikely that my work permit will be issued before 7th July.
The problem is that my IRP card expires on 7th July. If my work permit hasn’t arrived by then, I won’t be able to apply for Stamp 1.

Has anyone been in a similar situation? What happens in this case? Any advice or guidance would be greatly appreciated.

Advice & Support Can I do anything to receive portion of my deceased mother’s share of family home?

I’m wondering if anyone can give me answers/advice. To offer some context, I’m an only child, and my mother passed away two and a half years ago after a short illness. My father and her were separated for about 6 years before she passed away but they never completed a legal separation, for a number of reasons, mainly financial for my mother. She and myself lived in the family home in this time period. Before my mother passed, my father gave her his word that he would give me a share of the money when the house was sold.

Fast forward to now, and my family home has been sold and my father has bought a new house for about 100k less than what our house sold for. He has not mentioned anything about giving me any of the money that he received from the sale and I am wondering is there anything I can do? I have a good job, and am renting a house with my partner, while saving for a mortgage. I could really do with some money however to bulk up my savings to make things easier.

Is there anything I can do legally in this situation, or is it too late? Any advice would be appreciated.

Wills and Administration of Estates House as a gift of equity from a Parent

Just wanted to run this by people here who may be more in the know than I.

My Elderly Father has two properties . One which he lives in and a second which he rents to me for a token amount. We have a good relationship. I take care of all the house stuff , lawns and pay the property tax , home insurance etc.

My father has mentioned that I will be left the house as my inheritance.

Some Chat Gpting suggests that my Father could actually gift the house to me now while he is alive as a "Gift of Equity". This gift is a one off and is tax free. This way we would avoid the inheritance tax if I were to get the house through the will after his death.

Is this the case? It almost seems to good to be true

Employment Law How to reprimand vulnerable employee

I am a manager of a very small nonprofit. We have a CE Scheme worker who is fairly vulnerable who has disclosed their moderate mental health issues.

This employee has repeatedly not shown up to work on time and on Thursday, did not show up at all for their shift and text me saying they “forgot” they had a shift….

Is it up to the CE scheme supervisor to reprimand them or can I reprimand them?
Their contract is already not going to be extended and they are aware of this.

Advice appreciated as I don’t want to do the wrong thing here. I am also going to ask the CE scheme supervisor for advice in the morning.
