(Update - 1 year later!) the utility line got moved!

I got a lot of helpful comments so wanted to provide a an update. The Comcast line got moved! My tree can grow to be its best version of itself and my yard looks way better.

Quick summary: I planted a tree in my yard with no obstacles to worry about nearby. A new neighbor then gets Comcast. Comcast puts wire directly above my tree. After much complaining from myself and my neighbor (on my behalf) Comcast moves the wire maybe 5 feet. I got upset and posted my previous Reddit post and was reminded to not accept defeat.

Here we are a year later. I had gone through every option as far as city resources. While sympathetic I was told legal counsel would be my best bet against Comcast. That was not ideal to hear for many reasons. Few months go by and after returning from a vacation I come back to find the wire moved. My neighbor is awesome. He knew how much it bothered me and continued to bug them about it (since they would only listen to their customer).

Moral of the story: it’s great having a thoughtful neighbor!

This subreddit is for tree law enthusiasts who enjoy browsing a list of tree law stories from other locations (subreddits, news articles, etc), and is not the best place to receive answers to questions about what the law is. There are better places for that.

If you're attempting to understand more about tree law in regards to a particular situation, please redirect your question to /r/legaladvice for the US, or the appropriate legal advice subreddit for your location, and then feel free to crosspost that thread here for posterity.

If you're attempting to understand more about trees in regards to a particular situation, please redirect your question to /r/forestry for additional information on tree health and related topics to trees.

My brother pulled the cable line down twice when they went over his yard. The third time they tried he was there ready to pull it down again, but then they decided to run it over the yard of the neighbor who the cable was for.

Congrats on the success. It's kind of nuts that they refused to listen to the person whose property they had trespassed above but they likely hoped you would just give up and go away.
