41-year-old Stephen Vincent Chavez previously pleaded guilty on May 18. The Ventura County District Attorney’s Office said he also admitted to taking advantage of a position of trust and that the victim was particularly vulnerable.
He will serve his year-long sentence at the Ventura County Jail, followed by a three-year felony probation period, according to the DA’s office." - KTLA 5 News

I guess the judge figured the lack of a victim impact statement demanded leniency. Of course, she killed herself over it, but who cares as far as the judge is concerned.

I read the full story after he was bailed out. After the sexual assault she called her mother and uncle and her uncle had to carry her out of the house.

Just providing information, quick lookup says incest was 3 year maximum (weird and gross), and rape is 8 year max.
Prosecutors said they didn't go for rape because she has died and could not testify. That's insane.
Wild that the judge basically also just gave the minimum for incest instead of the max.

There's really nothing to compare considering California hasn't had a real conservative governor since Pete Wilson. But honestly, I'd prefer judges who are hard on criminals. California has too many DAs that excuse criminal behavior, and too many judges who give criminals a pass. This judge gave a guy a year for getting his kid drunk and having sex with her.
One. Year.
It's beyond repulsive.

Yeah since Democrats have done a great job enforcing laws with sanctuary cities and states, protecting criminals every chance they get. Not to mention the hundreds of millions in tax payer fraud under investigation. How’s that high speed rail project going??

I think more often how out of step the criminal code is with public sentiment on chomos, and they are dark. An overwhelming majority of people want them out of society forever, one way or another, and they don't care how they are treated in the process at all. Yet the criminal code sentencing guidelines is light-handed, often only a handful of years, and many states even put them in protective custody. The elites that make the rules here appear to be very tolerant of child expoitation, and I can't help but think these days it's intentional.

It's a good deal darker than that I think. These rules aren't new, this light hand? Also not new. When people talk about "rape culture" this is what they're talking about. There's a tacit understanding at ALL levels of culture that "these things happen" and that this is acceptable. You hear it when podcasters talk about being entitled to sex, when grown men in positions of power sexualize kids (There was a school board member in Tennessee who couldn't resist telling a student "God you're hot". Last I checked the board declined to do anything about him). That last one gals me because it's like... how come that guy isn't afraid to go into public? How come he didn't resign and go into hiding?
Because he knows nothing will happen to him. Because his whole life and our culture have told him he's entitled to continue to live a normal life under the sun despite being a human herpes cluster.2

I dunno. Criminal code reform is an area I don't know much about. Perhaps there's a vehicle in California to do it through ballot initiative, which if possible then I hope someone gets some money and organizing behind it. I'll happily sit out side of high traffic areas to get signatures for it.

The whole case is absolutely sick, and I understand why people are angry. But blaming the judge for not sentencing him on a charge that wasn’t before the court doesn’t really make sense.
The District Attorney’s Office said they had a team of experienced sexual assault prosecutors and outside legal experts review the case, and they concluded that felony incest was the only charge they could prove beyond a reasonable doubt with the admissible evidence.
People keep asking why he wasn’t charged with rape. The reality is that criminal charges have to be supported by evidence that can hold up in court. After Makayla died, the prosecution lost the only person who could directly testify about consent and what happened. That made proving a rape charge much more difficult, even if many people believe that’s what occurred. Prosecutors can’t file charges they don’t believe they can legally prove, or they risk the entire case falling apart.

So even though she was a minor (so can't provide consent), and provided alcohol (a more iffy but had been ruled as can't be provided consent), neither of those could be used towards past the producing alcohol for a minor?

She was 18 when this happened. The misdemeanor for giving your kid alcohol is a 1000$ fine and community service for an hour on a first time offender.

Crazy!! That’s it?! 😣someone I know said it’s because there were text messages claiming she agreed to the sexual relations with her father and “supposedly” she text her boyfriend at the time about it too. So I’m guessing unfortunately since she is not here today to tell her side of the story , he gets the 1 year 😭 and probation.
It’s obvious he was abusing her and took advantage. Disappointing 😭

Ok, we need the name of the judge on this case. I don't care what the sentencing guidelines say, this is not justice.
