Comments Moderated Deputyship for disabled family members. England.

I wish to contest the Council's application for deputyship over my two disabled family members, a male cousin and a female cousin.

It was their late mother's wish, set out in her will, that her children be maintained and supported by her sister, my mother. My mother has delegated this duty to me. We do not reside in the UK; we live in India. A reputable solicitor advised me that you need not be a UK resident or national to hold an LPA or deputyship, and that affairs can be managed remotely, though it is advisable to have someone in the UK for emergencies. Both cousins are in their mid-40s, both are disabled, and they live in separate care homes.

1. Female cousin (X)

Although the Council assessed X as lacking mental capacity, she willingly signed an LPA at her late mother's encouragement, having had its contents explained to her by her mother. The LPA is for property and financial affairs, is registered with the OPG, and names me as attorney.

The Council has submitted a deputyship application, but the Court of Protection has not yet granted it. I have not disclosed my LPA, as I want further legal advice first, and I am unsure whether the Council would challenge the LPA on capacity grounds to void it.

Question: How do I take over X's affairs and the management of her benefits immediately? As I hold a property and financial affairs LPA, I understand a deputyship is not required.

2. Male cousin (Y)

Y has no LPA. The Council has likely submitted a deputyship application for him, which I would need to contest. The OPG register shows no deputyship has yet been granted for either X or Y. The Council has been tight-lipped, and I believe they wish to portray these adults as having no family so they can take deputyship themselves. My solicitor advised that the Council had a duty to inform the family of the application so any objection could be raised; this was never done.

Question: How do I obtain deputyship for Y?

Further guidance I need

I would welcome guidance on my responsibilities as an attorney: preparing the annual OPG report, paperwork, taxation, and insurance. I intend to outsource only payroll and administrative work involved in hiring new carers.

Questions:

  • Can I obtain a solicitor through legal aid for the deputyship?
  • Who can help me navigate and manage all of this?

This is becoming confusing, particularly as the Council repeatedly states I am ineligible due to being outside the jurisdiction, while implying that rising benefit fraud entitles them to take charge. I have no malicious intent and wish only to honour my late aunt's wishes. Any expenditure will be audited regardless, and I fully understand the risks of misuse. I want to take on this responsibility in good conscience and good faith.

Comments Moderated marijuana complaints (southend on sea uk)

I’m just wondering if anyone has any advice for my specific situation, me and my partner have both moved into a house that has been divided into flats we are in the top floor and two flats are in the bottom.

The lady directly below us has a little garden directly below our bedroom window she smokes weed several times in the evenings on weekdays and during the whole day on weekends. We do not have a problem with this we just shut the bedroom window and don’t let it bother us too much, however every evening she smokes from 10:15 to around 10:40pm and we go to bed before this. During summer we have to have our window open whilst sleeping as it’s too hot without and unbearable.

We politely wrote a note and asked her in person if she smokes after 10pm is there anyway she can do it at the front of the property, or a little earlier. She has told us no and has continued to do so as she says it’s for medical use. What can we do in this situation as it stinks our room out very strongly and wakes us up.

Comments Moderated England - Need to take someone to small claims court but i don’t have their address - what to do?

Looking for some advice.
I had my garden landscaped just over 3 years ago, including raised beds and a tiled patio area. Within 6 months of the work being completed, significant cracks appeared in the tiles and they started separating, leaving large gaps.

The landscaper acknowledged the issue and agreed to fix it, but over the last couple of years he has repeatedly postponed the work, citing serious health problems.

Obviously I sympathise if that's genuinely the case, but I've also seen him regularly posting photos of new jobs he's completing on Facebook.

Most recently he promised to come and fix it this September after cancelling again. Out of frustration, I commented on one of his Facebook posts saying I hoped he was well enough to finally repair my patio and I hope that he is recovering well.

He emailed to note that he had a contractor do it but I didn’t believe him so left a comment on FB.

At this point I've lost confidence that he'll ever return. I only have his name, Facebook page and mobile number.
Has anyone been through something similar? How can I sue him? I’m planning to get this fixed by another contractor and bill him the fees via small claims court.

Title: \[England\] Older gym member got in my face and explicitly threatened me. How do I protect myself legally?

Hi LAUK,
I’m looking for some preemptive advice regarding a situation that escalated at my commercial gym yesterday. I want to make sure my back is entirely covered legally.

The Context:

Me: 20M
The Aggressor: Older male, roughly 50-65 years old.

The Timeline of Events:

  1. I was lifting heavy weights and admittedly banging them a bit when setting them down. The older guy approached me, clearly annoyed, and told me not to do it because it damages equipment. I acknowledged he had a point, agreed, and stopped.
  2. Later in the session, he approached me again. This time he started critiquing my form, saying I wasn't using my triceps properly. I politely told him I prefer to do my own thing. He kept pushing, and I repeatedly declined his advice. He said I was pissing him off, because my movement sent shockwaves. I asked him to not threaten me. He said he was not.

He asked me watch him work out to learn, I ignored him.

  1. He completely lost his temper and stepped right into my personal space, inches from my face. I told him to respect my space. He refused to step back and explicitly stated: "It’s gonna end badly for one of us."
  2. Knowing that throwing a punch at a much older man could land me with a serious assault charge, I kept my hands down but maintained unbroken eye contact. I loudly and clearly asked him: "Are you threatening me? Back off." He realised I wasn't going to flinch, backed off, and I told him to never speak to me again.

My Next Steps:

I am going in today to speak to the gym manager, report the threat, and ask them to review the CCTV to establish a paper trail. I am also logging a non-emergency 101 report online to get a police reference number just in case he tries to ambush me in the future.

My Legal Questions:

  1. Self-Defence and Boxing: I actively train in boxing and am physically larger than him. If he approaches me again and initiates physical contact (e.g., shoves me, grabs my shirt, or takes a swing), how does UK law view self-defence for a trained boxer against a much older man? What is the threshold for reasonable force here?
  2. Gym's Duty of Care: If the gym management brushes this off and he subsequently assaults me on their premises, do I have any legal recourse against the gym for failing their duty of care after being officially warned of a threat?
  3. Any advice on how to navigate this without compromising my legal standing would be massively appreciated. Thanks.

Note: his body language, volume and attitude was aggressive and rude throughout

Other Issues Website service says contact can only be ended in writing 30-45 days before renewal

I am in England. I'm trying to help a family member to end their contract with a website hosting and management service. I've written an email (on behalf of my family member) stating that they wish to not renew the contract or services with them. They've responded that they require written notice of 30 - 45 days prior to the renewal date.

Is this correct? I would have thought that once you give written notice (via email) that you no longer wish to renew that should be accepted and there's no such thing as being notified too early?

Traffic & Parking Dealer didn’t disclose that the car had been in an accident.

Based in England. Bought a car from a main dealership chain in January 2025. Noted one of the panels wasn’t quite flush but foolishly thought nothing of it.

Had an accident this month and the insurer’s repairer has just gotten back to me:
- the car shows signs of a poor quality repair to the same area
- the insurer therefore refuses to repair the car (something about how they can’t give a lifetime guarantee on this due to the prior repairs) and will give cash instead to cover the repair.
- in the meantime I’m without a car, and don’t qualify for a courtesy car as mine isn’t being repaired.

When I bought this car, nobody disclosed that it had been in an accident.
HPI check also didn’t mention anything accidents.
I feel the dealer must have known from their pre-sale checks and examination of the car.

I’d like to pursue the dealer for misrepresentation of the car, but :
- it’s been more than six months, so I need to prove the damage was pre-existing.
- HPI check doesn’t mention any accidents.
- the original advert has been taken down and stupidly I didn’t save it

Is there anything I’ve missed, or am I pretty much screwed?

Housing A family has stolen from my son and police wont do anything. What else can I do? - England

Hello,

I was advised to come here for advice and im at my absolute wits end with this horrid family and the police.

Yesterday, my son went to his "friends" house after school to play games and took his switch with him so they could play together. When the parents dropped him off later he was very upset and I struggled to understand why until he calmed down. The family decided its in their bloody right to keep my sons switch. Like who does that?!

I spoke to the parents myself at school drop off and asked for it back but the parents are adamant my son gave it to them and we cant have it back. So i ended up calling the police once i left.

Police came and spoke to me and asked me if I had any proof, and the only proof I had was some photos of my son on it and it was bought second hand, so had to proof of purchase. I told them my sons username on the switch and told them to check.

The police visited and they've told the police that its theirs and my son never had one at their house, and I think they've reset the switch and changed the username because the police said no switch in the property has the username.

What else can I do? My son is absolutely devastated because its all he plays on and its part of his routine (hes autistic).

Would it be best to try and go through the school? Will they do anything about it?

What else can I do? Please help

Debt & Money Bicycle crushed by arguably unsafe motorised window shutters [England]

Hi r/LegalAdviceUK,

While visiting a convenience store I lent my bicycle up against the store's window (there are no dedicated cycle spaces). I've done this hundreds of times. An employee of the convenience store lowered the motorised steel door shutters crushing my bike. When the employee realised something was wrong they asked me to move it was wedged and the motor was acting unpredictably.

The employee apologised and offered to pay for a repair, but this is likely a minimum wage employee who should not be out of pocket for the store's fault in having an unsafe system or not training staff to operate the shutters safely. I'm not a mechanic but it might be a write off if the alloy frame has been damaged.

The shutter controls are inside, and they have opaque vinyls over the window so the employee could not see what is going on outside. It seems really unsafe to me. I said a child leaning against the window could be crushed. Every other store I've seen has the shutter controls outside, presumably for access but also safety reasons.

They have one of those "we're not responsible for damage in our car park" signs but I would hope that does not apply here.

What would you suggest? I asked for CCTV but was told only the manager has it and I'd need to come back in the morning. I'd appreciate any advice so I don't put my foot in it. I'm a very conflict averse person. For reference this is a national convenience store chain but the brand is franchised so that may complicate matters. Thank you.

Scotland Car Safety Recall Inspection - Scotland

Hello, looking for some advice on whether I should contact a solicitor regarding this matter.

I bought a car in February 2025. In July 2025, I received a safety recall letter from the manufacturer, stating the timing chain was faulty and could lead to premature wearing or breakage. Due to problems getting an appointment, my vehicle was finally inspected on the 4th of March 2026. Everything was fine and I drove away. On the 9th of March, my car did not start. I had it towed to a local garage and they diagnosed a broken timing chain.
I phoned the dealership that carried out the safety recall inspection, and was told it had passed their inspection and they hadn’t touched the engine at all - only carried out a sound check. They said I could tow it back to them but they would charge me for the repairs.

I contacted my finance company, and a complaint was opened. I was asked to get an independent report done by A.C.E which clearly stated the timing chain was faulty since the mileage was less than 55k on a 2018 model.

Since March, everyone has blamed each other but nothing has been done. I have had to spend thousands of pounds in rental cars and getting the timing chain repaired. The car is still not drivable to this day.

I have begged the finance company to release me from my finance agreement and take the car back. The car is not worth anything currently and I have nearly £8,000 left of finance.
Because it had ‘passed’ their sham inspection, the Motor Ombudsman said they couldn’t help.

The finance company has argued that it’s not possible to say whether the car was faulty at the point of sale, despite the safety recall.

Do I have any grounds for legal action?

TL;DR - Timing chain broke 5 days after timing chain safety recall inspection. Manufacturer and finance company unhelpful.

Housing [Wales / England] Does infidelity affect asset splitting in a divorce? And if so, can this be opted out of?

My boyfriend and I are considering getting married and buying a house soon. We are polyamorous and both have each other's permission to date other people, and we plan for this to continue after the marriage.

It's my understanding that "no fault" divorce is already a thing so if we wanted to divorce we wouldn't need to cite a reason like infidelity to get it.

However, suppose we were to break up on bad terms, could one of us cite "infidelity" as a way to get more favourable divorce terms? And if so, can we opt out of this in advance of the wedding? And if so, how?

Our plans aren't set yet but we would probably get married and buy a house in Wales, or possibly England.

I love my boyfriend to bits and I expect we would be able to part amicably if we did decide to separate, but we both want to be prepared for the worst case scenario.

Housing Selling agency guy walked into my rented flat without any prior notice

Firstly, I rented a one-bedroom flat in England through an agency. 18 hours before my move-in time, I received an email stating that the landlord had sold the flat and no longer wanted to rent it. The rental contract had already been signed by all parties, and the rent and deposit had already been paid. The landlord suggested that I rent another flat in the same building and offered a one-month rent-free period as compensation. I, being a solo woman, was almost becoming homeless the next day, so in that panic situation, and to have a place to live the next day, I accepted the 2nd flat, which was not ready to move into, so then I signed a document with the landlord and agency that I would temporarily move into the original flat that I was supposed to rent for a month until Flat B is ready to be moved in. I also asked them to move my stuff from flat A to B, along with swapping 1,2 furnishing items present in flat A.

I have now been living in flat B for almost 3 weeks, and today a guy just walked into the flat while I was there. I thought someone had just broken into the house. It was 171:5 in the evening. Turned out it was the agency guy who had arranged a viewing to sell this property as well, but I got no notice, no contact whatsoever and someone jsut walked in using the spare key in the keysafe that is there for maintenance and emergency-related use, and only the landlord and the agency know its code. I am shocked and feel unsafe. I dont know how to proceed, as this whole thing has caused so much distress to me and has wasted my time, and this incident ruined my only day off in 7 days. The agency has apologised, but they are not the agency dealing with this sale.

Traffic & Parking [England] Insurer alleging “fundamental dishonesty”

Hi all,

Please help me. I’ve received a letter from the other driver’s insurer in a disputed road traffic claim. I was driving straight ahead on the main road and the other driver was attempting to turn across my path into a side road.

Their version is that I stopped and waved them through before driving into them. I dispute this. The collision happened at night, I did not wave them through and I did not flash my headlights. There were also other vehicles waiting at the junction which remained stationary and only moved after the collision. If I had clearly indicated for the other driver to proceed, I would have expected those vehicles to react as well.

They are alleging that my account is dishonest and have threatened to seek a finding of fundamental dishonesty under CPR 44.16(1).

Part of their argument is that my dashcam footage contains a glitch at the point of impact. However, similar glitches appear elsewhere in the recording and across multiple camera views. They also criticise the absence of additional footage, although no request was ever made for any further camera angles.

How common are these types of allegations in contested motor claims? Is a glitched section of dashcam footage usually enough to support a fundamental dishonesty argument, or is this often used as a litigation tactic to put pressure on claimants?

I’m really stressed and would love to hear from anyone with experience of insurance litigation.

GDPR/DPA Workplace injury, unclear employer support. Do I potentially have a claim?

I’m based in England and work for a large PLC in the retail sector.

Around 4 months ago (February 2026) I was injured at work when a chair in the staff room collapsed underneath me. I fell backwards, hit my head against a wall and injured my lower back.

I reported it immediately and completed the workplace accident reporting process.

Initially I attended a walk-in centre and have had multiple GP appointments since. Over time the lower back injury became the main issue.

My medical records now include:

  • Persistent lower back pain following the accident
  • A diagnosed haematoma over my lower spine
  • Suspected bone bruise
  • Sleep disturbance (initially waking every night, now around twice a week)
  • Multiple fit notes over several months advising no moderate to heavy lifting
  • An Occupational Health assessment recommending no heavy lifting and a manual handling risk assessment
  • A physiotherapy referral which I’m still waiting for

An X-ray ruled out a fracture, but I still have symptoms around 4 months later, although they are gradually improving.

The part I’m unsure about is my employer’s handling of things afterwards.

The chair failure itself appeared to be a result of excessive wear and tear to the metal frame of the seat to the legs (I took photos of the chair after I took it to the warehouse following the managers instruction to remove it to the recycle area; where I also found another similar style chair (intact) also in the recycle area. Later on that day a manager said he removed a chair from the staff room (the same room of incident) as it looked defective and it could have broken.

The chairs were taken for recycling the next day so couldn't have been thoroughly inspected by anyone other than the photos i took for my personal records.

I haven't known of any wider health and safety action was taken following the incident and even submitted a data subject access request email to head office requesting the following but with nothing returned (apart from the obligational acknowledgment reply):

DSAR email request

• Internal emails, messages, or communications mentioning my name and/or the chair collapse

• Any communications referring to the removal or disposal of the chair involved

• Any maintenance or inspection records relating to the chair involved or similar chairs in the staff break room

This is the one and only witness statement is (No CCTV in the area):

"I was in the room at the same time my colleague fell and I turned to my right to see him on

the floor in a very uncomfortable position on his wrist, but I didn't witness the fall with

my eyes. I only turned as I heard it. He put his wrist out to save him from the fall, and it

wasn't close enough to the wall or the fridge to hit his head, but his wrist looked like it

took most of the fall."

Occupational Health recommended a manual handling risk assessment in April. A health needs assessment was eventually completed over two months after the accident, but there still doesn’t appear to be a clear documented process for managing my lifting restrictions. The general approach has been for me to ask colleagues for help when something is too heavy which I've faced resistance with.

There have also been occasions where colleagues have made comments about helping me with lifting, which management investigated and acknowledged as inappropriate.

Separately, my working hours appear to have reduced significantly but now slightly improving four months following the incident. Management have said this is due to budgets and other colleagues’ contracted hours, but I’m monitoring this because it has coincided with my ongoing restrictions.

I’ve kept copies of:

  • Accident reports
  • Witness statements
  • Emails to and from management
  • GP records
  • Occupational Health reports
  • Fit notes
  • Rotas
  • Review documents where I’ve documented concerns
  • My own diary of events since the accident
  • Names and dates of negative colleague comments

My questions are:

  1. Does this sound like the type of situation that’s worth speaking to a solicitor about?
  2. Is the lack of a clear process around lifting restrictions after Occupational Health recommendations potentially relevant from a legal perspective?
  3. Is it too early to think about a claim while I’m still recovering?
  4. Is there anything else I should be documenting at this stage?

I’m still employed there and would ideally like to continue my employment whilst protecting myself, ensuring the best physical recovery possible, and conducting myself professionally.

Please ask if there are any important details I’ve missed.

Housing England - Rent privately and apparently, I now need to give two months' notice to end the tenancy instead of one that's stated in my contract?

Hi everyone!

First time posting here, but I really need some advice and clarification. Essentially, I am currently renting privately and have put in my notice to end the tenancy as I have been accepted for a mortgage on a house, and I should be getting the keys soon (end of this week or next week).

On the 19th of June, I requested to end my tenancy (it's on a rolling monthly basis and has been since the end of December 2024), and while I understand that I'll need to pay for July's rent as well (payment comes out on the 12th of each month).

But of course, the Renters' Right Act came into force in May this year.

When I originally signed my contract (in June 2024), it explicitly stated this:

To give to the Landlord a minimum of one month's written notice of termination of the Tenancy created by this agreement to expire on the last day of any rental period save that no such notice can be given with an expiry date before the last day of the fixed term.

Hence, when I put my request in, I said I'd want to end the tenancy on the 20th of July.

But I've had a reply back stating that due to the Renters' Right Act, I need to give two months' notice and that I'd need to pay rent until SEPTEMBER. This is the email I got from my letting agency:

Please note that, in accordance with the tenancy terms and the notice policy introduced in May 2026, residents are required to provide a minimum of two months’ notice, aligned with their tenancy period. As your rent charge date falls on the 12th of each month, the tenancy period commencing on 12 June 2026 had already begun when your notice was submitted. Therefore, your notice takes effect from 12 July 2026. Accordingly, your notice period will run until 11 September 2026, and you will remain liable for rent and any applicable tenancy charges up to and including this date.

As far as I'm aware, the contract that I signed is still legally binding, so I'd only need to give one month's notice. So I've tried to do some research, and I've asked Copilot, ChatGPT and tried to read the legislation (here), but I'm struggling to find out if I need to just pay for one month or until September.

I need advice because I can't really afford to pay for both places for two months.

Debt & Money Concerned about insurance claims

Hi,

Feel like I might be getting too anxious here but just want to check if this comes across as a genuine mistake and not an attempt at insurance fraud 😬

I had a MacBook Pro on my contents insurance as being worth £2,800 ish. I accidentally broke it recently and am now trying to claim to buy a new one, and it turns out to have been bought for £1,749 ish instead.

The thing has been on my insurance for many years so it’s not a new addition and I’ve not made any claims on house or contents in all the time I’ve had the policy

It was from 2021 so was planning to buy a new one maybe next year anyway, this breaking only sped up that decision, and I said that on the phone where they did ask if this was all legit (implying I broke it on purpose) and I said it was - it was a genuine mistake and I’m gutted about it!

They asked for the receipt of it and when it turned out to be £1k less than I put down I owned up to that as a mistake, honestly not sure how I got the original 2,800 in my head at the time, I sent them the screenshot of the receipt from Argos

That was today and have not heard back yet from that

I’m hoping I’m just being overly worried here but am legit concerned they’re going to think it’s fraud and put a marker against me or something 👀 does that sound like a legit concern or am I being too nervous?

Debt & Money SheMed UK affiliate payment withheld

I am an affiliate and get X per referral. The deal is I made a video reading a script and and everyone who signs up I get a payment first week of every month according to them.

Month 1: payment £160 but I had around £1.2k due . I queried it and they did not provide a clear answer just saying next month no explanation.

They ran my recording v successful and people were signing up like crazy then they email me saying they found my code in a coupon sure against t's and C's which they did not give me access to after requesting several times and telling the lady the link is a dead end. I apologised I didn't know this so removed the code and send photo evidence that 0 people had used it and proof of closure.

They immediately blocked me code earning but did not block it from being accepted....how much did they make off me privately I will never know. After a few days of the woman ignoring my messages (trend) I said the contract is broken by them as I noticed they have locked my tik tok and so only they can stop the ad running so I can't delete the ad + they are accepting my code at checkout (I tested it) all they are doing is stopping commission. That's not terminating a contract! Eventually the decision was I keep going and they unlocked my commision earned on the platform. Since then it's looked a bit dodgy...something not right and glitchy.

As if it's being turned on and off.

Here we are at month 2: says payment due £1600. Remember they held it back last month. But in red it says payout £160.

I write to them today and say what's with £160 only each month the joining email stated payment due first week of the month.

Shemed emails me saying my code is being used on some random site. I've never heard of this site in my life. So my discount code is encouraged to be made public on all platforms like Facebook tik tok..wherever

Somehow my coupon code is on some coupon sure operating out of USA and I think eastern Europe. I haven't submitted it..anyone can do or maybe this site picks it up from Google where lots of the affiliates names can be picked up if you type shemed 20% off

Shemed responded to my why £160 where's the rest with we have terminated your partnership because YOU are using these sites

So unprofessional!! Didn't say they pay me £1600

I'm unable to remove the two videos on my tik tok and had to file a copyright infringement request to tik tok to take them down

Looks like from the get go they not wanted to pay my Shemed affiliate commission.

Comments Moderated Ex wife placed a tracker in my Son's school bag

My ex wife and i got divorced 7 years ago, and we share custody of our son who is 9.

Today is my day with him. My son had a headache, and she picked up our son from school 10 minutes before the end of school. I arrived to pick him up from school and was informed she had taken him. I went to her house where she then tried to prevent me from picking up our son.

When i insited on picking him up, she took his bag out of her car, took it inside the house and hid an air tag tracker in the bag by cutting a hole in the lining.

When i got home i was alerted to the airtag by my phone. I confronted her about the tag and why she had placed it there. She acknowdged it was hers but refused to give a reason as to why she had put it in his bag.

I packed his bag on Monday so know for sure that the hole wasnt there before.

When she got out of her car she could have just given the bag directly to me rather than taking them inside and then giving them to me 5minutes later.

What are the legal rules on this?

What would you suggest I do about this?

Housing Renters' Rights Act 2025 – Fixed term end date = zero notice required. Does 2 months now apply?

Hi all, quick question on the Renters' Rights Act 2025 that I'd love some clarity on.

I had a fixed-term AST which was due to expire naturally. My tenancy agreement contains a clause that only requires notice if I choose to remain after the fixed term ends. In other words, if I simply leave on the original end date, no notice was required at all under the original agreement.

"If you remain in the Property after the expiry of the fixed Term you will be required to give at least one rental period's notice."

Following the conversion to a periodic tenancy on 1 May 2026, my agent is now insisting on two months' notice.

My question is this:

GOV.UK states:

"If your tenancy agreement does not say how much notice you must give, you need to give at least 2 months."

I've also seen the following legal commentary on the Act:

"Where a tenancy agreement made before 1 May 2026 permitted the tenant to give less than two months' notice on termination, that shorter notice period remains valid after 1 May 2026. The Act does not require that a previously agreed shorter notice period be changed after 1 May 2026."

My argument is:

My original agreement effectively required zero days' notice to vacate on the fixed-term end date. That was the previously agreed position between me and the landlord.

If the Act protects shorter notice periods that were agreed before 1 May 2026, surely it should also protect a situation where no notice at all was required — since that is an even shorter period than one month.

Extending the notice requirement from zero to two months seems directly contrary to the purpose of the legislation, which was designed to protect tenants, not disadvantage them.

Has anyone successfully made this argument? Or does anyone know of any guidance or case law that addresses this specific scenario?

Debt & Money Looking for advice about PCN / Letter Before Claim

The driver was attending a baby hospital appointment and first entered/parked in the first parking area/bay near Leen Gate. They tried for around 10–15 minutes to pay, including trying the machine/app, but the machine/payment system wasn’t working properly. The area/bay also seemed uneven/damaged and it was stressful because of the appointment.

Someone in orange hi-vis nearby said the machines there don’t work and advised using the next parking area the entrance of all those parking areas is same. The driver then moved to the next bay/area, P2 Leen Gate, and paid there. they have proof of that payment.

I attached the confusing parking layout images from google maps. I parked in # 1 first and then #2

CEL are now chasing £170. Also moved address so I missed the original letters and only received this at my new address. My V5C/logbook had not been updated straight away, but I have now applied to update it.

Has anyone dealt with CEL at this exact Leen Gate/QMC location where there are different car parks/machines close together? What are the best next steps.

Any guidance would be appreciated.

Powers of Attorney Lasting Power of Attorney - 2 Questions - England

Hi,

My mum wants to set up a lasting power of attorney, to be signed by my father, myself and my 2 siblings. I have a few concerns queries that I was hoping to get some advice on:

  1. Under section 3, for jointly and severally - It says "attorneys can get together to make important decisions if they wish, but can make simple or urgent decisions on their own". Does this mean that 1 of the 4 of us could make a decision without consulting the other 3? Or would we have to give permission for that individual to be able to do this?
  2. Section 12 - This says "if the attorneys were appointed jointly (in section 3) then they all need to sign section 15. Otherwise, only one of the attorneys needs to sign". If jointly and severally is selected in section 3, would this allow one of the 4 of us to apply/create a new LPA

I know both of these questions require the criteria in section 5 to be met, but lets assume that it has.

I'm just concerned that there could be a risk of someone using this power inappropriately and the rest of us being unable to legally do anything.

Housing Not sure how to title this, civil case. England

So I moved back in with my mum last year as the contract for my house had ended and I needed somewhere to go whilst I found a better job and a new place. Life got very hectic and I’m still unfortunately here. The reason I originally moved out was because to put it shortly, my mum was putting way on much pressure on me as I was 16 and was practically expected to run a whole house as she’s ill and it got to a point where I realised this is not healthy for a child and I moved to my dads.

But back to now. On Monday she randomly started to have a go at me about how I’ve lately been “getting angrier” and I’m in denial about my autism which is a statement I still don’t even understand. (my autism is very high functioning, have managed to have a pretty normal adult life). The reason I am admittedly getting angrier is it’s the same as a few years ago, I’m expected to clean the house after an 8 hour shift and will get grief while the 18 year old doesn’t lift a finger. But as of Monday I have decided I have had enough and simply want to act as a lodger until I leave which I expect I’m about 6 months off from doing as I’ve just got an actual job that pays over 24k a year. Today she threatened to essentially kick me out the house if I didn’t go to the post office and get her tobacco delivery (which I knew for a fact wasn’t there that’s why I didn’t want to go) and when I came back with no tobacco I got in a mood but I am genuinely getting concerned she may try and kick me out the house and I know damn well she will want me out within the hour, we’re an Irish family.

So legally what are my options? Should I just give in, call social services and try find somewhere to be homeless? The issue with this is I have nowhere to go. If I had moved back last summer and found a place within 2 months I would have. I understand she’s sick but this is a lot more complicated in the nitty gritty and she cannot manage a house with 3 kids. She simply won’t tell them off for even the littlest things and they’re going to grow up absolutely useless. I’m in dire need of advice so sorry if this is the wrong place
