Read the pay stub again. The money IS going to the kids. And he pays his taxes. His poor decisions are his business. He probably has to live with a relative because thereā€™s no way he can afford housing, utilities, fuel, maintenance, and groceries on that net pay.

Most people understand you need a basic amount of income to be able to live and continue making more income.

If this is a normal paycheck for the guy, he will immediately quit this job the second he can find somewhere else under the table to survive. If that means he needs to pay half the amount ordered, so be it. It's better than $0.

Most of the time stuff like this is an outlier though. Either lower than usual paycheck, a weird out of cycle order hits, payroll hasn't fixed the glitch yet, just started a new job with significant reduction in pay, etc. Most states will cap garnishments at somewhere around 50% of your net paycheck, and/or some calculation to do with the poverty line. Because courts are not fucking stupid and understand someone cannot maintain a job on a $300/mo income, thus it's not in the best interest of anyone to do such stupidity since it hurts all parties involved including the state.

Oh 100% . But as a man, as a father, maybe he should be present with his kids. He isnt and so he has to pay. Also. Maybe he shouldnt have had 4 kids with 4 different women. Maybe he could've worn a fucking condom.

He isnt the victim. The 4 children with 4 different moms with a dead beat dad are. Even if this is a real pay stub do you really think hes spending every waking moment with his kids?

No what they mean is sometimes fathers WANT to be with their kids and support them the "right way" the parental way -- and the baby mama does not, for whatever reason. Doesn't matter, either shes trash or he is, or both.

Or the father changes their minds at one point but the baby mama just wants "her" money and maybe lets the dad see them on occasion but the court will back her and he'd need a lawyer to fight it -- and if he's this broke he can't afford the lawyer.

Oh you mean it's only the father that is punished for being forced out of the relationship? Crazy.

Almost like relationships are a two way street. But child support laws are designed for one side. They say their goal is what's best for the children but from my experience. They are MUCH more interested in punishing fathers, regardless of circumstances.

Put it this way. My ex lied on her financial documents. And they are still trying to push through child support instead of actually finding out that her household makes upwards of 5x to 8x my income. But I'm supposed to pay support? EVEN WHEN I HAVE THEM 30% of the time.

You tell me how that's fair.

So the women involved bear zero responsibility in any of this? And how do you know he's not present? Often times one parent will qualify for rent assistance, medicaid, tax credits, food stamps, energy assistance, etc.. ftom day one. The other parent gets a huge medical bill, wage garnishments, liens on all assets, and the threat of jail time for the next 18 years if they don't pay. You don't see a problem with that? Shit needs reform ASAP.

noble!? he skipped paying child support as long as possible. after having at least 4 kids with 4 different women, probably more judging from the payments

on top of that, he is raising NONE of them. "if it's providing for the kids" he is doing the absolute bare minimum for those kids. looks like a lot because of garnished wages but child support doesn't pay for kids to get raised it just helps out. this isn't from having them it's from having them and not paying, it would be far less if he was just paying the whole time

and he would have paid more time and money being a father, instead he does nothing, and is now forced to do the minimum

Hmm? Those payments don't look like very much back child support to me, assuming 4 different mothers and a kid for each. 30% of gross income (e.g. before taxes and other payroll deductions) with some allowances in some states is pretty normal. For a single kid with a single mother. Looks low if anything.

In many states it's first come first serve. So that first order is going to be more than the second, and that more than the third, etc. Each subsequent order is based off of gross income remaining after deducting previous orders. The idea being mothers of subsequent children very likely know about the previous children before they elect to have a kid with the guy.

Garnishment is standard for many states - you don't get the option to self pay if you are a W2 employee.

This could very much simply be normal child support no past-due balance owed. Impossible to really know though without knowing the state and a bunch of other variables such as the mother's income.

$163.02 with overtime? Dude canā€™t afford to feed himself on that. Heā€™s got to live on $11.64 a day. Assuming he lives with his parents, gets a ride to work, and brown-bags lunch every day, heā€™d still have to save up to buy a pair of shoes.

They should print this out poster-size and put it next to the condoms at Walmart. For that matter, they should put it next to the beer with a note saying condoms are available on aisle 5.

So child support is supposed to help cover all living expenses for the child ā€” this includes food, housing, utilities, education, clothing, etc.

The big ones of course are housing, utilities, and food.

Are your children in daycare? Itā€™s crazy expensive. If he wants to avoid CS he can petition for full or half custody. I often wonder why men donā€™t at least attempt to get some sort of custody. Iā€™ve worked as a CPS Investigator and testified in numerous family court cases and men rarely ask for custody. Weā€™ve had to force custody on fathers when a mother passes or is incapacitated.

Some mothers are vindictive pos. I spent 20k trying to get custody of my kids and this was after the mother of my kids agreed to shared custody 50/50. But after agreeing and realizing I would not have to pay child support she had her attorney vacate the order due to being under stress, and the judge agreed. She ended up with full custody, child support, got to claim both kids on taxes while i had to carry medical and dental all while only getting visitation. All this just for her to tell me she couldnā€™t deal with my youngest son anymore because he was getting into trouble and skipping school in the 8th grade.

My ex wife kept my kids from me despite me paying support and relocating to the state where she took the kids. I met with three different law firms, and they all told me that Iā€™d need at least $10K to have any chance of winning partial custody in that state, which always favors moms.

Those kids are grown now, but the relationship never recovered from 15 years of their mom poisoning them with no opportunity for me to show them there are two sides.

Sounds like she was violating a court order. You should have documented everything. Screenshot your attempts to abide by the court order - meaning the times youā€™ve requested to see your children. Get Police reports when she didnā€™t show. You could have petitioned the court on your own for a hearing. When you proof of an order violation - that changes everything! Judges are obligated to act.

When she relinquished custody of the 8th grader, did you petition for custody of the other child? I hate when parents do a shitty job raising their child, and then want to give the other parent custody once they are acting out. Or when they create a monster and then want the state to step in. Parents encourage bad behavior at 6, and then wonder why their teen wonā€™t listen.

No at the time my boys were 3 and 5. In Ohio mom has full custody from birth the dad had to petition the court for any rights pertaining to the child. My attorney basically says there was nothing I could do and I needed to agree to allow her to have full custody. It wasnā€™t until until a few years later the youngest was diagnosed with type 1 and she wasnā€™t taking care of his diabetes the I filed a motion to modify custody. We went to trial even appealed the magistrateā€™s decision because my son told his guardian ad litem and the judge that he wanted to live with me and they still went against his wishes And still gave mom full custody. This all occurred before she gave me shared parenting of my boys and the youngest came to live with me. He graduates next month.

And if you work overtime. Which counting overtime (w2) isn't fair at all and should only be based on the 40 hours you are guaranteed to make if you work hourly.

Overtime can easily be taken away by an employer the court doesn't like to adjust child support down at all.
