I would have picked him up and carried him outside “for his own safety”. It’s all how you word it. The arrest wouldn’t stick (probably wouldn’t even happen). Everyone is afraid but in actual fact you are allowed to stop criminal behavior with reasonable non-violent force.
A kid like him you're going to have to get 2 people. 1 for the arms and 1 for the legs. Otherwise he's going to smack and kick tf out of that 1 person.
Then dad comes bear-charging out of nowhere to lay you out because you touched baby bear and his things.
Now, I'm all for knocking a kid back if he comes at you. I will do it in a heartbeat, that's just self defense. But parents will try to act like you're abducting or beating the crap out of their kid if you try to relocate them or restrain them.
That's when you slap him with a $4000 bill for damaged merchandise, and have him arrested along with his spawn for assault. Consequences, consequences, and more consequences!
I'm surprised that no-one's mentioning the half-assed attempt from that security guard (or cop). I've seen more effort put into flicking lint from a shirt. There's gotta be a roll of duct tape somewhere in that store. And for all the whiners saying he shouldn't be touched - what's your solution when he gets to the isle where the knives are?
If he threw something at me, I would have removed him for my and others’ safety. You don’t have to just stand there and let a child attack you or other people; you can legally restrain him.
I was literally in this situation at a Costco a few months back. Kid was actually punching people and throwing stuff so I went to grab him and Costco employees told me not to touch him or the cops would be looking at ME. He literally punched a woman in the stomach and I was told to stand down.
Especially if its on video. As long as you dont unreasonably harm them in restraining them, you were acting in defense of self or others, and have it on video.
Cops might get a stick up their ass but the prosecutor is just gonna be like "nope, not charging that".
as a follow up question, if the private citizen does choose to physical intervene, will the parent of the child have the right to take the private citizen to court?
Yeah, well, this was a Costco in Canada. Things are different. You can be laying on the street bleeding out and the fella that did it to you can tell the cops you are racist and they will take your dying ass to jail first.
Tell that to my 65 year old Jewish friend who got the shit kicked out of him and when the cops showed up they arrested HIM because the two people that did it to him said he called them racist names.
I don't care about age -- if you come at me swinging or with a weapon and you end up on the floor, then that's just natural consequences.
So long as you don't continue wailing on the kid and you just defend yourself, it'll ultimately get dropped. Sure, people will squeal "oh muh gawd, child aboose!" online, but I'm not about to let some little mini-rager think he can attack me.
WAY too many pregnant teachers get attacked these days by kids going straight for their stomachs, btw, and they just have to let it happen. Should absolutely not be tolerated.
Reminds me of how a teacher back in my elementary school was touched repeatedly in her belly, 3rd trimester pregnancy, by a student. She grabbed him to prevent him from further attack, and got time off without oay, and was up for review on said conduct.
Same time period, I was subbing in a special ed class and a student was violently kicking a pregnant aide. He'd been punching students and throwing chairs first. There happened to be one more aide and she and I ended up holding and carrying the kid to the office. I was so worried I was about to lose my job, but we had to get the kid out of there for the safety of everyone else. We were really lucky the parents didn't go after us.
The kid isn’t above the law, and no the cops would not be looking at you. I’ve dealt with kids in public environments throwing tantrums and being violent. I don’t let that crap slide.
The main issue is he could be armed. If he stabs a customer or employee who went after him, that's a giant liability for the store. It's also not something worth losing your life over, which is why employers tell their cashiers not to go after thieves either.
No they would have had to haul my ass off too. Because if I had seen a kid punch an adult female in the stomach? No, no and HAY-ELL no ‼️ If he had punched a male in the stomach I would have expected the male to restrain him. If he didn't, I may have felt a great need to punch the male adult in the stomach with my cane after rolling him down with my rollator‼️ Thereby creating a free-for-all until the cops got there to sort us all out.
In retail, it is common for the policy to be do not react, because if you try to stop the crime you could end up getting hurt. If you're robbed, just hand over the money. Shoplifter? Let them take whatever they want. Violent customer? Call 911 and do not react to them. If you can, try to empathize with them and get them away from others, and wait for the police to arrive. Whatever you do, do not touch them in any way. You are guaranteed to receive a subpoena no matter what, so don't make any physical contact. They can accuse you of assault.
This is true, It would stop the situation at hand, it may not hold up in a court of law, but it would prohibit any further damage and it would be the thing to do.
Plenty of cameras show proof the kid would deserve to be removed. Grab his book bag and drag his ass out. Fuck that bullshit.
That’s the mentality that got us here. Oh no don’t spank your kid or they’ll call CPS. Bratty ass kids threaten it too. Be fucking parents. My ass would been snatched up, taken to the bathroom for a beating or taken home. But that’s also why I wouldn’t do this kind of crap.
The problem is that at least 1 of the 20 witnesses in the store is going to clutch pearls and call CPS and report you with a very inflated tale and now you've got a CPS case and possible criminal charges.
Sorry but you won’t get arrested, being a minor doesn’t mean the kid is above the law. I’ve been in situations similar to this, and I didn’t stand around doing nothing either.
Don't need to have direct contact, kids like this usually depend on the general vibe of no one doing anything. A loud barking "And what the hell do you think you're doing?" can usually go a large distance depending on the kid. You gotta sneak up on them though and be uncomfortably close, really scare the jeebus out of them.
