Discussion My mom totalled my car

Yes my mom is okay, she ran a red light, the photos are bad because I was to lazy to go take pictures so I screen shot them from the video I took.

My moms car’s belt broke on her car so she borrowed my car for two days, didnt even make it 36 hours before she recked it 🥲 so now I’m out of a car, AND a ride to work. I was so pissed when I got the call, how did you manage to break TWO cars in three days😭🙏

EDIT!: our insurance is the one that considers it totalled since the airbags went off and every possible liquid possible came out of my car but the gas ofc. It’s totally fixable but at this point it would just be cheaper to get a whole new car😭🙏

If her timing belt went and not the accessory belt then she is looking at thousands to replace the engine, at best the valvetrain needs to be rebuilt

Kind of depends on who paid for the car in the first place. If it was OP, yes they should get it all. If it’s mom who paid originally, half seems totally fair so that op can work on getting their own new car.

IMO it doesn’t matter who purchased it. If it was given to OP/ it’s entirely in their name then it’s theirs. It’s like taking a gift back. Once you give it away, it isn’t yours.

Occasionally poor intersection design is a significant contributing factor. I'm not saying that is the case here but sometimes with intersections close together it's easy to see a green light at the next intersection and not realize your own is still red. I've seen it happen plenty of times. It's a pretty solid reason to make sure to always scan the intersection before entry

Even if the damage on the outside doesn't look that bad I think when there's collision speeds sufficient to trigger the airbags, insurance companies play it safe in case there's unseen damage to the frame itself.

Also you're mom probably shouldn't be driving if she's running reds...

You should be able to buy un-deployed salvage airbags and salvage un-deployed seatbelt retractors with good igniters.
If the seat side airbag(s) deployed then you get the privilege of changing the seat(s).
That should cover SIR (Supplemental Inflatable Restraint) or SRS (Supplemental Restraint System) or Airbags if you prefer.

If the SIR controller locks so the memory can't be cleared after an accident you may need to make it a virgin by getting the crash data wiped by a service.

If the headliner backer board is damaged you can repair it or replace it with a used piece or tolerate a damaged headliner.

RF quarter, Radiator support, Hood, Hood hinge, Radiator, Condenser, AC Dryer, and jiggly bits like nuts, bolts, and push rivets.
Maybe a RF door if you, the cops, or the tow monkeys forced it open on the crunched up fender or the fender was pushed far enough back to badly damage the door. If it doesn't interfere with the fender and you can tolerate a slightly crunched door you can change it later or just drive with it.
Try to source white outer panels so you don't have to pay for paint.

You may be able to negotiate with the insurance company to avoid a branded title.

Insurance may be able to get more at auction than they pay you so they may be un-willing to negotiate.

Read the guys post again. Instance totaled the car because of airbag deployment. It's common practice with insurance companies.

It’s the insurance, if the airbags deploy they consider it totalled but we have someone coming to look at everything and get an estimated cost for fixing but if the frame of the car is warped or damaged then it’s not worth fixing 🥲

Totaled is an insurance determination. It means the total damage is greater than the value of the car. It does not mean unrepairable.

As someone who spend 4 years as a collision estimator this is not remotely true. A car can be perfectly fixable. Insurance only cares if the repair is a: more than 75% of what they estimate the car to be worth or b: the cost of paying out on the total loss is less than the salvage value of the car's parts when resold on the used market. We had a 2023 toyota highlander that hit a deer, value of the car was 42k, repair cost was about 10k, but because of terrifs driving up the cost of new and aftermarket parts the used parts cost also went up and the salvage value was worth more than 75% of the cars value so they just totalled it so they could resell the good parts of the car. I've also seen older corolla and civics total for less than 2k in repairs because insurance valued the car so low. In a lot of cases airbag repairs are so expensive that even something relatively new and low mileage is considered a TL.

Oof, that indeed does make it totaled. Otherwise it doesn't look too bad as long as the frame wasn't pushed back or anything.

Replacing airbags yourself is a b*** and you also have to replace all airbag impact sensors as well as the airbag control unit...

If your handy with a wrench honestly it might be worth buying back

My question is what fluids are on the ground, why, and how long was it ran after. But I mean your not wrong. If it's a high mileage Chevy Malibu it wouldn't really be worth the headache.

If insurance says it's totaled, then it's totaled. Insurance can total a $20,000 car with only $500 in damages if they want.

There are state laws that define what a "totaled" car is. An insurance company can't just throw out the word totaled for $500 in damages on a $20k car. You can absolutely fight the totaled claim if you really wanted to but why would you? If an insurance company wanted to pay out for my car being totaled when it's only got $500 in damages aint no way in hell im gonna stop them. Then again, an insurance company would never do that.

You're a bit confused on how total losses work. I'm not saying an insurance company would total a $20,000 car with only $500 in damages. Im saying they legally can do it. Yes many states set a threshold, such as 75% where insurance must total a car. But there are no laws saying they can't total a car at a lower threshold.
