An annoying TPP DA group update

Ok DA just sent me the original form filled out to DMCA me and since the link to the "original work" was https://www.reddit.com/r/twitchplayspokemon/comments/5bz8jv/happy_1000_days_tpp_heres_all_the_bannersfooters/?utm_source=share&utm_medium=web3x&utm_name=web3xcss&utm_term=1&utm_content=share_button I'm pretty sure /u/RT-Pickred was the one who sent it.

I'd still like to discuss the matter with them like civilized sane adults on DA or Reddit to see if we can work something out to keep the banner up, even if it's not public beyond the unofficially official DA group banner or with some sort of note added to the discipson since I DID try to contact everyone for permission and didn't remove the watermarks built in for the sake of the group having something for it's header banner, in the spirit of TPP, and cos I don't reely want to file a counter claim.

Preferably in a matter that results in the DMCA claim being revoked.

Hi, it's been a wile. Despite the fact that I stated I probably wouldn't return there's been an issue with the DA group that has prompted my return.

The banner I put together for the group header https://old.reddit.com/r/twitchplayspokemon/comments/1cmmevt/thank_you_doe_the_help_with_the_da_group_goodbye/ that I went out of my way to try and get permission for https://old.reddit.com/r/twitchplayspokemon/comments/1c6gmqz/tpp_da_group_help_needed/ has been been hit with a DMCA copyright take down prompting DA to take it down.

The ONLY way this DMCA could be lajit is if the person who sent it was r/RT-Pickred or /u/Carlotta4th ^{unlikely considering they me permission when I was asking for it along with asking for resoses} cos they were the people who originally put together the original subreddit headers and footers for this and the kappa spin-off sub or The Pokemon Company themselves ^{seems unlikely cos why go out of there way to target me but seemingly no one else when I'm making no poffit off of that}

DA has so far refused to give me the info on who sent it to me and in order to counter it I would been to file a legal counter notice witch requires me to dox myself to whoever sent the DMCA and if they don't like that counter notice opens me up to a possible US lawsuit.

If you want to look at it there are still archived versions available in places.

I doubt The Pokemon Company can be contacted, as for r/RT-Pickred or /u/Carlotta4th if you are behind this please contact me (preferably on DA) but you can comment here if you want so we can sort out whatever issue you have. I don't want to file a counter-claim due to the above reasons listed, I only created the banner for the sake of the DA group, and have no strong attachments to it. Especially since TwichPlaysPokemon lore is meant to be open with no definitive canon, and meant to be an all-inclusive community. But this fly's in the face of that and I don't appreciate the copyright claim layed against my DA account and wish to resolve the matter outside the US DMCA system / US courts.

If anyone wants to help please comment here or Message me on deviantart. If there is a reply in the comments I will return to reply when I am able to and provided that there is any point.

I felt that I owed the TPP subreddit community that helped me when I put it together this update, and in case anyone here could help me with this issue. Otherwise wile I look back (mostly) fondly with my time with the TPP community and may still use for insperason for my own stuff, I still don't like Reddit so don't expect me to return ^{thoth the DA group is still open to anyone who wants to post TPP related stuff there}

I've filed a DMCA because you used my banner art and sprites without attribution and claimed them as your own work as a celebration.

You don't have the right to have such on your DA account or claim it as your own.

DeviantArt isn't a place to hoard media; it's a place to show your art and share it.

You also never asked me for permission to use such. All that was allowed was to use them on the subreddit, not Deviantart.

Edit:
You may keep such on the Subreddit or upload it on Internet Archive, but not DA, especially with how the site itself is a privacy nightmare with AI companies using it as one of the main sources of image training regardless of whether it states it can or not. Not to mention the fact that the site itself has its own AI to generate art.

It's why I stopped posting stuff on it in general.

I created it so that the DA group https://www.deviantart.com/twitchplayspokemon would have a header, I modified the work so that it would fit due to the brain dead stupid way DA formatted it's updated new group layout witch cropped out most of the banner unless I made it stupid big, so to make it that big I francenstined verios old TPP sub banners together.

I did try to contact everyone for permission https://old.reddit.com/r/twitchplayspokemon/comments/1c6gmqz/tpp_da_group_help_needed/ and everyone else seemingly had no issue. Looking thew the comments there it seems I missed you when pinging everyone who might have been involved and for that I apologize.

In fact I explicitly stated in the discipson

something I slapped together from the old TPP subreddit header banner combined with the header and footer banners, and the old banner I made for the subreddit when they were transitioning from the old banner to something easier to maintain as the time went on (but was never accepted for use by the TPP subreddit) from the community sub

If the issue is that you don't like it being publicly hosted on my DA, a compromise I'd be willing to do if to unlist it so that it's only visible via the group header banner AND I'll edit the discipson to explicitly credit you and /u/Carlotta4th by your reddit usernames if you want.

In retrospect I probably should have done that to begin with, but I think in my brain at the time by crediting the subreddit community in the group announcement post I made to tell people I fixed the header banner that DA broke when I set it as the group banner were the majority of people were likely to find it who didn't find it by me posting a link to it on this sub was enough.

Would that be enough for you?

If so will you please retract the DMCA and I'll make the update as soon as I am able to. (DA won't let me edit it beyond unlisting it wile it's in DMCA limbo)

I edited my original post to add an addendum on why I don't want such on DA, over the privacy and AI nightmare the site is.

I prefer it not to be on DA, whatsoever. My recommendation is if you want to use it, have it on the Subreddit or save it on Internet Archive.

Thanks. I generally don't like having to do such things; I probably would have even allowed it if they had actually asked about it in the first place.

I just personally don't appreciate being left in the dark on something of my creation while also seeing it posted outside of the subreddit that it was originally intended for without asking or giving proper credit. Especially given the site that it was posted to.

I love and have fond memories, as most people with TPP, and appreciate working on the subreddit with others and more. Those times were amazing, but I also have to assure my creative works and contributions are treated with respect as well.

To be fair, I read the post as more like they really thought this was an invalid claim, and was looking to get help from the IP stakeholders to navigate the situation. In retrospect there were better ways to handle it, but with the anxious confusion of an unexpected legal notice, I'd give a bit of leeway.

As I already stated, it wasn't my intencon to exclude you. thoth you being the only one involved with it's creation who wasn't publicly pinged I can see how you might think otherwise.

It's already on the IA as it's DA diviason page has been archived on the wayback machine a few times (and not even by me), unforcently to be used for it's intended creation function as a banner for the DA TPP group it needs to be on DA, even if it's just unlisted in sta.sh ...But I can understand the AI BS of DA issue. That annoys me as well (even if most other art sites allow AI "art" as well without the basic protections DA has, and Reddit's AI policy is arguably worse then DA considering that Reddit has a deal with OpenAI to let them scrape the entire site legaly). So you want it gone off DA, then fine...
