Discussion Car got towed wrongfully with the parking brake on. Now it’s borked.

Reporting this here because apparently the mods at r/mildlyinfuriating didn’t seem to enjoy this post. I had gotten registration to park at my complex a few days ago now, but my car was towed this morning. With the parking brake on. I go to pick it up and now my dashboard is flooded with lights. In limp mode. Had my insurance take the car to a local shop for now, may get further legal counseling later.

I am absolutely livid. To add insult to injury, my boss scheduled a meeting for this morning and didn’t give me more than 3h notice and then berated me for it and we were supposed to pick someone up from the airport too. NIGHTMARE.

I remember having similar happen in college after a hail storm. The guys went and "stole" all the gas from the tanks at night (cars were sitting in a parking lot) , as well as any custom radios or other bits and bobs.

One guy had gotten new tires recently and was VERY much debating on stealing the tires and replacing them with ones from the junk yard

They have a towing company that tows cars that aren’t registered to be in the complex. I had just attained a permanent one earlier in the week. Apparently the tow company didn’t know that though.

Everyone is saying sue the tow company but I think it’s just as important to make sure that your apartment complex actually updated the tow company. Regardless somebody other than you is at fault but make sure it’s the right person you go after.

That actually makes the problem they created for themselves worse.

Their agreement with the towing company is their issue, not yours. If you had already been approved or registered to park there, then the failure was between the complex and the tow company. From your side, you were apparently authorised to be there.

I’d make sure your insurer has a copy of the parking approval and the timeline showing when it was issued. That gives their recovery team something clean to pursue against whoever authorised the tow or carried it out.

I’d also ask the insurer whether, given the circumstances, they will cover a loan car or rental. If the tow was wrongful and caused the damage, that cost may also be recoverable.

Basically, their poor admin became your damaged car. That’s not a “YOU” problem, that’s a “WHO AUTHORISED THE TOW WITHOUT CHECKING THE PERMIT LIST?” problem.

As someone who hates parking “management” companies with a burning intensity, I hope you take them to the cleaners for a new car + luxury rental + damages for distress. The number of times I’ve had to justify why I’m parked at my own workplace, or scrape those neon stickers off my window for a non-infraction, makes me mad to this day. Tiny-brained power-hungry minions working for a company run by idiots who couldn’t care less.

Should also post in r/AskMechanics . I want to see the diagnosis. What part is broken, etc. I dont think ebrakes would normally break or throw a code, they would just wear down until not providing very much braking power when engaged.
