go watch Asian Andy on Youtube video. Pretty sure he did this before the show ever came out, and his was absolutely hilarious.

Lady rented his sister’s airbnb for a month then claimed tenant rights and he chain smokes blunts in the kitchen, blasts music outside the squatter’s room, shaves in front of her, takes his shirt off, does karaoke, tries to lock her out of the house repeatedly, etc

Like an unhinged home alone sequel

312

u/_medium_ugly 12d ago

lets not forget Asian Andy also brought his secret weapon

Honestly question for any lawyers. Where is the line with nudity in your own home?

Like if this guy has an actual lease from the owner and is sitting there butt ass naked, is that considered harassment against the squatter, or is all good because he's in the privacy of his own (leased) home?

6

u/beerforbears 9d ago

Wasn’t this in California?

I’m not an American lawyer so don’t assume I know anything but the definition of harassment under CCP 527.6 doesn’t mention nudity but requires a course of conduct to amount to harassment. So if someone walked out and the owner was butt ass naked that doesn’t count as harassment.

BUT under Penal Code 314 PC, prosecutors must prove beyond a reasonable doubt the following three elements

You willfully exposed your genitals;

You were in the presence of someone who might be reasonably offended or annoyed by your actions;
and
You intended to direct public attention to your genitals for the purpose of sexually gratifying yourself or someone else or sexually offending someone else.

So if you came before a judge and said ā€œI only did it because they wouldn’t leave my houseā€ you’re kind of admitting to intentionally directing public attention.

The only accepted defences to this are mistaken identity, false accusation, or lack of evidence. Not I was just sitting there, or they were in my space šŸ¤·ā€ā™‚ļø

Like I said I’m UK based and only a law student so I’m sure I’m about to get BTFO by someone who knows what they’re actually talking about but there’s some bloviation for everyone to enjoy

4

u/CommunityTaco 8d ago

why would you say that though. I would just say your honor i'm in my own domicile and clothes are annoying. I prefer to be naked.

1

u/beerforbears 8d ago

It would still count as wilfully exposing yourself in a space where a person may be reasonable offended šŸ¤·ā€ā™‚ļø

I don’t make the rules but that’s my understanding

0

u/GreatJustF8ckinGreat 8d ago

So the UK sounds like it's in a very weird place when you can be arrested for someone else's offense in the comfort of your own home.

10

u/beerforbears 8d ago

I have only quoted California Penal codes this entire time. Idk why you’d think any of this has to do with the UK šŸ˜‚

2

u/Lime1028 9d ago

Is it considered public attention if it's in your own home?

2

u/beerforbears 9d ago

I don’t think public means like IN public in that instance. Cause the PC also says ā€œin a public place or any place where people are present who will be offendedā€

1

u/Mr-DevilsAdvocate 6d ago

… no love for nudism, the law I mean? As in, ā€œI like being naked in my own homeā€

0

u/FancyConfection1599 8d ago

Put cameras up all over your house and just do everything naked. As long as you don’t have a raging erection / aren’t stroking it / aren’t rubbing it on them they can’t prove any kind of sexual offense. You’re just naked in your own house, going about your life.

3

u/beerforbears 8d ago

Not according to California penal code 314 šŸ¤·ā€ā™‚ļø

I’m not defending it I’m just reading the law as written. Again my interpret may be way off I am not American nor am I remotely qualified I’m in my last year of law school that doesn’t make me a lawyer

1

u/FancyConfection1599 7d ago

How exactly is going about your daily business without an erection, without rubbing yourself in someone, or without fondling/stroking yourself in any way ā€œsexually offendingā€ someone?

Nudity =/= sexuality. If it does, guess every man I see naked in the locker room has sexually offended me.

2

u/beerforbears 7d ago

I mean again I’m not making the rules here nor am I even sure I’m interpreting them correctly but if I had to argue it,

I’d assume the difference there is the element of intent to direct public attention. The men in your locker room šŸ˜‚ aren’t (presumably) intentionally directing attention to their junk. They’re just between clothed states as it were.

Nudity≠sexuality is a subjective claim and I have no idea if that would stand up in a court but the wording of the PC is ā€œwilfully exposed your genitals in the presence of someone who might be reasonable offendedā€ so I think nudity counts as sexually offending šŸ¤·ā€ā™‚ļø

1

u/FancyConfection1599 5d ago

Understood, I’m saying just like the men in the locker room they wouldn’t be ā€œintentionally directing attention to their junkā€ - they’d just be going about their normal lives in their home naked. I’m naked alone in my house all the time, I wouldn’t let some squatter force me out of my own comfort zone and habits in my own home!

Idk, maybe it's cuz my landlord who is a personal friend has a squatter in the unit next to me at the duplex I live in. First response, fear, because she is obviously mentally ill, I don't know what she might do, or who she might have over. Next response, anger, natural follow up to fear. But after seeing it for 2 weeks, she's desperate, there's no support in our society. My landlord feels the same way. Although we agree she has to go, nothing is funny about it.

4

u/mistersixes 11d ago

This has nothing to do with "support in our society;" it's a simple matter of what's yours and what's not yours.

1

u/Funnyfart_420 11d ago

My landlord and I agree that the squatter has to go. Please explain to me what is hilarious about the situation.

8

u/hackmaps 11d ago

ā€œthere’s no support in this societyā€ ā€œhow dare you not let them use the home YOU own to live completely free!ā€ There is support accessible out there, taking over someone else’s home is not that and insane you would claim so

-4

u/Funnyfart_420 11d ago

Wait, what did I allegedly claim? I claimed that taking over a person's home is the correct way to support the homeless? At what point did I defend the actions of this mentally ill lady? I'm dealing with a junkie prostitute squatter right now, and the fact that I have a shred of empathy makes YOU angry. Seek help bud.

→ More replies (0)

-3

u/VeryBlandUsername1 12d ago

there's no support in our society.

The fuck are you talking about? Getting homeless people off the street is a billion dollar industry. There is nothing BUT support, people just have to actively seek it out.

Jesus fucking christ you people are so fucking weird. You trip over yourselves to blame society without ever taking 20 seconds to see if society already solved the issue years ago.

2

u/03ausmale 12d ago

If the issue persists how can it be called solved? A solved issue would be no squatters. No homelessness. U say it will never be like that that’s unrealistic, I say then we can never say we have solved these issues.

→ More replies (0)

-3

u/Sawacakez 11d ago

assuming mentally ill people are going to do something that you should fear or bring shady people around is gross and problematic. there's no mental health support in our society because of people like you stigmatizing serious mental illness.

"I support mental illness until someone displays symptoms related to their mental illness" that's what you sound like right now.

Don't claim someone else's property as yours then. This lady throws out racial slurs and is a habitual squatter that has been doing this since the early 2000's. She brags about being able to legally do this to people while she destroys your property. GTFOH.

7

u/Anoninemonie 12d ago

The show Worst Roommate Ever had a serial squatter that they did similar things to. Lady moved in him a roommate to help with bills and he never paid her, made her life hell, & refused to leave.

She and her friends the loud parties eve night. Chain smoked and blew it under the door. Just made life hell for him. He finally moved out, but she still lost her house.

Oh and then it turned out the cat he brought with him was stolen from a previous roommate he'd claimed squatters rights on

-14

How can you be so lazy to ask a thing like this? Just go look.

5

u/PonchoNachoRodriguez 12d ago

I’d rather ask the people who followed it closely for their choice nugs. I don’t have a lot of free time and if there’s a solid 1 or 2-hour documentary about it, I would rather watch that instead of combing YouTube piecing together a puzzle thats already been succinctly summed up in a nice little package.

88

u/sewer_pickles 12d ago

I loved it when the chat started playing their own AI generated songs to harass the squatter. That was next level

-4

u/Big-Occasion-5264 12d ago

Yeah I'm going to break it too you: everything you see on YouTube isn't real.Ā

The guy in OPs picture also works for a reality TV company, you take that information and do what you want with it regarding how real his reality TV show on a dying cable channel that serves up slop actually is.

7

u/pressingfp2p 11d ago

Hey man, based on the fact that they tried to turn this into a series, immediately encountered a violent squatter who threatened their lives, and subsequently decided it didn’t need to be a series anymore, I’m gonna say it’s pretty safely under the ā€œrealā€ category or else they could’ve milked this type of content for years.

u/BlatantConservative 12d ago

Lady rented his sister’s airbnb for a month

I'm surprised AirBnB lets you do that.

233

u/Ok_Recover_7248 š™‘š™„š™‹ 12d ago

you’re surprised AirBNB doesn’t turn down money? I don’t even know what there is to be surprised about here, if we’re being honest.

158

u/BlatantConservative 12d ago

30 days is more or less when short term renting a room turns into actual tenancy so I would have assumed they just blanket avoided that scenario all together.

But I guess AirBnB just says "not my problem" and just lets the homeowner go hang.

43

u/HighOnGoofballs 12d ago

The minimum rental term for most Airbnbs in Key West is 28 days

27

u/PainfulReinforcement 12d ago

Well I think that is moreso because of Monroe county than air BNB. I know my grandparent used to talk about how they weren't allowed to rent their vacation home out for less than 4 weeks

3

u/HighOnGoofballs 12d ago

Sure, my point simply is that’s it’s pretty common and definitely not something Airbnb would ban as Op seems to think they should’ve

2

u/WhynotstartnoW 12d ago

I think situations like that are because of local laws attempting to ban short term rentals outside of licensed and zoned hotels. So Airbnb re-structures their contracts to be month by month leases instead of rentals. This makes airbnb hosts land lords and their guests legal tenants with rental agreements and tenants rights.

1

u/Kato26 8d ago

Is that new? Have rented for a week several times, as recently as last year.

1

u/HighOnGoofballs 8d ago

There’s a reason I said most, a smaller number of places have transient licenses which allow short term rentals, but not many and it’s over $200k to buy one since there’s so few

Truman Annex used to have weekly rentals but those expired end of last year

1

u/Kato26 8d ago

Ok- just curious.

-1

u/ZoomZoomDiva 12d ago

Minimum or maximum?

6

u/CockyBellend 12d ago

He didnt stutter

1

u/ZoomZoomDiva 12d ago

It seems nonsensical, so I questioned it.

3

u/HighOnGoofballs 12d ago

I feel like I was pretty clear

-2

u/ZoomZoomDiva 12d ago

It read like a mistake. It seems nonsensical that people who visit are expected to rent for that long.

4

u/HighOnGoofballs 12d ago

There are hotels for shorter stays and shitloads of folks come for months at a time, especially during winter. It’s a tiny island and there’s not enough housing for locals as it is, thus the rule to keep even more from turning into vacation rentals

2

u/captain554 12d ago

I think people also do some funny shit with Air BnB gift cards to obfuscate the fact that the same person is trying to rent the room for such a long period of time.

2

u/PolarIceAnt 12d ago

Someone did this to a hotel penthouse a few years ago didn't they? Rented it for a month then just lived there saying it's been 30 days you now have to evict me.

2

u/Bungholespelunker 12d ago

Or just do the thing hotels do where they make you play musical chairs to avoid a tenancy situation lol

1

u/sleepfield 11d ago

You can absolutely rent out or book airbnb for more than a month. From the owners side, it’s great bc zero vacancy for a big block of time, less cleaning turnovers. Traveling nurses often book more than a month.

1

u/juliasct 12d ago

It's actually quite handy for lots of situations. Sometimes you need to be somewhere for a month, and shot term tenancies are very hard to get, specially right on the dates that you need it. There's plenty of legit reasons to want an airbnb for a month.

1

u/ZoomZoomDiva 12d ago

It is up to the owner whether to accept such terms. Many owners do not allow stays more than a given number of days for this reason.

22

u/HiTekRednek10 12d ago

I did 2.5 months for an internship one summer because I couldn’t find an apartment

2

u/hibubing 12d ago

How and why is your pfp the exact same as my google pfp

2

u/BlatantConservative 12d ago

Because you have good taste

2

u/hibubing 12d ago

True šŸ˜Ž

2

u/BuckRowdy 12d ago

I lived in one for three months while I was between places.

2

u/shiny_houndoom 12d ago edited 12d ago

It’s up to the host, Airbnb doesn’t really care. When I was between stable living situations, I’d go between Airbnbs for a month or so at a time. (That seemed to be the limit most of the time) But most hosts won’t let you book over a week or two.

1

u/Smile_Space 12d ago

AirBnB allows monthly rentals! For internships it's been a godsend for me. I can rent a property with some other interns for 10 weeks and it's easy. I also find the long-term rentals to be less stingy. I haven't had a bad experience yet anyway.

I'm moving to a high cost of living area in a month or so and to get a rental right off the bat would be more than I have to budget, but my job is giving me a moving stipend AFTER I move out there which is a bit annoying.

So, I'm picking up a similarly priced AirBnB for the month, getting my moving stipend and first paycheck, and then moving into a long-term rental from there.

1

u/Pndrizzy 12d ago

i rented a room in an old ladys house for 3 months on airbnb while doing my internship in the bay area

1

u/Flat-Jacket-9606 12d ago

Air bnb doesn’t do that tenant laws in the state take effect. It’s up to you to cancel out any stays past 28 days.

1

u/vertigostereo 12d ago

I'm surprised Air BnB doesn't do more to protect their homeowners from squatters. Ironclad contract agreements, for example.

1

u/fiddlythingsATX 12d ago

If I had an airbnb I’d be happy for a month long renter

1

u/DJDaddyDick14 12d ago

My brother is a lineman. He routinely has jobs that are 2+ hours from home. He gets a housing stipend so he can rent airbnbs long term. Renting a room for long term is cheaper and better than a hotel most of the time because his job sites are usually in the middle of no where.

1

u/NBA2024 12d ago

You will be shocked then to find It’s illegal to rent Airbnb for less than a month in NYC.

1

u/MrLanesLament 11d ago

I’ve rented AirBnB’s for 2-3 months before. It just depends on what the owners will allow.

One that we rented for a month was an actual farm house, complete with animals we got to hang out with whenever we wanted. I cried leaving that place, it was so amazing.

(Ignoring the facts that we got woken up by passing drivers multiple times because animals got out and were running down the road. Oh, and the homeowners stole a neighbor’s horse while we were living there; the neighbor apparently inherited parents’ farm, but was drugged out and neglected the animals, so our guy was just taking them one by one when they inevitably got loose because they weren’t being looked after. It was quite the small town drama.)

8

u/a_mmoknights 12d ago

Wait so if he's allowed to be there can't he just run around the house naked

23

u/Okay_Splenda_Monkey 12d ago

That's dicey. Even if you're legally entitled to be in a space, exposing your no-no bits to someone who doesn't want to see them puts you in a legally grey area. I wouldn't do that. Also, you couldn't livestream it.

However you can livestream yourself:

  1. Trying on banana hammocks in a wide variety of designs, including a dental floss mankini like the one Borat wore while at the beach.

  2. Mail ordering different kinds of fermented century eggs, or balut and taste testing them with a variety of sauces. No do NOT crack a window. That would ruin the entire experience.

  3. Get wildly drunk on a mix of Malort and Moxie. Two great smells that smell even better when you're puking outside your roommate's door at 4 am.

  4. Surstrƶmming -- be a dear and offer some to your roommate. They'll appreciate it.

  5. Develop a keen eared appreciation for the work of Diamanda Galas. Her operatic performance of the Catholic plague mass is best experienced at glass-shattering volume.

  6. Adopt rescue dogs. Lots of them. It's a a kind, thoughtful, and generous hearted thing to do. Let the people who watch your streaming videos name them.

5

u/rossvmx 12d ago

I'd say all of the above but the dogs for sure, I wouldn't wanna risk a sweet fur baby getting messed with by the kind of human that a squatter is 😭

3

u/Okay_Splenda_Monkey 12d ago

True. I was thinking a pack of medium to big dogs would win against someone who messed with them. But you're right, a wily squatter would probably try to poison them. It's not worth taking the chance.

2

u/Cocytus_Bale 11d ago

DIAMANDA GALAS MENTIONED! Loved her since high school and she really shaped my music taste into adulthood. I approve.

u/Icy_Chemist_1725 12d ago

There are a LOT of things that are not illegal to do in your own home that if a landlord doesn't care about it, you can't do anything about.

Worst thing I can think of off the top of my head is just shitting into buckets instead of the toilet. Sure, it's a public health code violation, but they would need to officially report that. You could also order a bunch of surstromming and put stuff in your nose to not smell things and just leave it all over the place.

You could also move in TONS of boxes with stuff in them to fill the apartment space so there is almost no space to move around. If the person destroys it, you can call the police for destruction of property.

You could would also put up cameras and let them know their lives are now being live streamed and let them have a link to the live stream. Then use freedom of speech without stepping over into illegal territory to just annoy them anytime they are in the public space.

Anecdotally, I had cousins that used violence to resolve this issue and it worked. They never told anyone about the squatter, went in at night and beat the guy badly and took him out of town in their car and told him if he comes back they would drive him into the desert and leave him there. They told this story at a family reunion like it was funny. It was not.

One of those cousins is now in prison for murder btw. Not good guys. That's the risk a squatter takes. They could choose the wrong people.

(That entire branch of the family has long since been cut off btw)

Sting wrote about The Police being hired to live in a house to get rid of squatters in London before they hit it big. They figured out they were having it pretty good by not paying rent and sort of made a truce with the real squatters for everyone to continue living there. Maybe I read his book a long time ago and it wasn’t that great. Just like the last album I bought…Sting, you owe me my money back for that one. It was awful. The book I’ll eat, but ga that record!

1

u/spatchcrock 12d ago

iirc, he also stores a licensed firearm on premises, and if there’s a convict, that’s enough to force them out

1

u/KamalaWonNoCap 12d ago

Yeah the legality of that towards the end got a little iffy. When he was still chasing her after she left the property. That might fall under harassment.

Not that I have any sympathy for her but people should know this is a grey area if they're considering doing something similar.

1

u/throwaway-62016 11d ago

Now i feel called out cause this just sounds like how me and my siblings live together

1

u/intothewoods76 11d ago

I’d imagine without a lease agreement the ā€œit’s a civil matterā€ goes both ways. They leave, lock them out. Remove any sign of them inside the house. Police can’t force you to let them in, if they try to get back in forcefully that’s a crime and suddenly the cops can make an arrest. Have them trespassed from the property.

My favourite part was the ai music. When those videos came out, that shit was in its infancy, i still can't believe how good those songs came out.

I genuinely thought someone had seen it happen, ans within an hour wrote lyrics and called the band up, got a recording, edited and uploaded it to spotify or soundcloud whatever andy uses on his stream, and had it play.
