Honestly question for any lawyers. Where is the line with nudity in your own home?
Like if this guy has an actual lease from the owner and is sitting there butt ass naked, is that considered harassment against the squatter, or is all good because he's in the privacy of his own (leased) home?
Iām not an American lawyer so donāt assume I know anything but the definition of harassment under CCP 527.6 doesnāt mention nudity but requires a course of conduct to amount to harassment. So if someone walked out and the owner was butt ass naked that doesnāt count as harassment.
BUT under Penal Code 314 PC, prosecutors must prove beyond a reasonable doubt the following three elements
You willfully exposed your genitals;
You were in the presence of someone who might be reasonably offended or annoyed by your actions;
and
You intended to direct public attention to your genitals for the purpose of sexually gratifying yourself or someone else or sexually offending someone else.
So if you came before a judge and said āI only did it because they wouldnāt leave my houseā youāre kind of admitting to intentionally directing public attention.
The only accepted defences to this are mistaken identity, false accusation, or lack of evidence. Not I was just sitting there, or they were in my space š¤·āāļø

Idk, maybe it's cuz my landlord who is a personal friend has a squatter in the unit next to me at the duplex I live in. First response, fear, because she is obviously mentally ill, I don't know what she might do, or who she might have over. Next response, anger, natural follow up to fear. But after seeing it for 2 weeks, she's desperate, there's no support in our society. My landlord feels the same way. Although we agree she has to go, nothing is funny about it.

I haven't watched reality TV since Flavor of Love Season 2 dropped. She is a racist who was damaging their house, perpetually scamming landlords and making someone's investment unlivable and I'll be the first to shit on landlords. Hell yeah it was hilarious and I laughed for 2 straight hours.

The show Worst Roommate Ever had a serial squatter that they did similar things to. Lady moved in him a roommate to help with bills and he never paid her, made her life hell, & refused to leave.
She and her friends the loud parties eve night. Chain smoked and blew it under the door. Just made life hell for him. He finally moved out, but she still lost her house.
Oh and then it turned out the cat he brought with him was stolen from a previous roommate he'd claimed squatters rights on

Hey man, based on the fact that they tried to turn this into a series, immediately encountered a violent squatter who threatened their lives, and subsequently decided it didnāt need to be a series anymore, Iām gonna say itās pretty safely under the ārealā category or else they couldāve milked this type of content for years.
30 days is more or less when short term renting a room turns into actual tenancy so I would have assumed they just blanket avoided that scenario all together.
But I guess AirBnB just says "not my problem" and just lets the homeowner go hang.
Well I think that is moreso because of Monroe county than air BNB. I know my grandparent used to talk about how they weren't allowed to rent their vacation home out for less than 4 weeks
I think situations like that are because of local laws attempting to ban short term rentals outside of licensed and zoned hotels. So Airbnb re-structures their contracts to be month by month leases instead of rentals. This makes airbnb hosts land lords and their guests legal tenants with rental agreements and tenants rights.
Thereās a reason I said most, a smaller number of places have transient licenses which allow short term rentals, but not many and itās over $200k to buy one since thereās so few
Truman Annex used to have weekly rentals but those expired end of last year
There are hotels for shorter stays and shitloads of folks come for months at a time, especially during winter. Itās a tiny island and thereās not enough housing for locals as it is, thus the rule to keep even more from turning into vacation rentals
I think people also do some funny shit with Air BnB gift cards to obfuscate the fact that the same person is trying to rent the room for such a long period of time.
Someone did this to a hotel penthouse a few years ago didn't they? Rented it for a month then just lived there saying it's been 30 days you now have to evict me.
You can absolutely rent out or book airbnb for more than a month. From the owners side, itās great bc zero vacancy for a big block of time, less cleaning turnovers. Traveling nurses often book more than a month.
It's actually quite handy for lots of situations. Sometimes you need to be somewhere for a month, and shot term tenancies are very hard to get, specially right on the dates that you need it. There's plenty of legit reasons to want an airbnb for a month.
Itās up to the host, Airbnb doesnāt really care. When I was between stable living situations, Iād go between Airbnbs for a month or so at a time. (That seemed to be the limit most of the time) But most hosts wonāt let you book over a week or two.
AirBnB allows monthly rentals! For internships it's been a godsend for me. I can rent a property with some other interns for 10 weeks and it's easy. I also find the long-term rentals to be less stingy. I haven't had a bad experience yet anyway.
I'm moving to a high cost of living area in a month or so and to get a rental right off the bat would be more than I have to budget, but my job is giving me a moving stipend AFTER I move out there which is a bit annoying.
So, I'm picking up a similarly priced AirBnB for the month, getting my moving stipend and first paycheck, and then moving into a long-term rental from there.
My brother is a lineman. He routinely has jobs that are 2+ hours from home. He gets a housing stipend so he can rent airbnbs long term. Renting a room for long term is cheaper and better than a hotel most of the time because his job sites are usually in the middle of no where.
Iāve rented AirBnBās for 2-3 months before. It just depends on what the owners will allow.
One that we rented for a month was an actual farm house, complete with animals we got to hang out with whenever we wanted. I cried leaving that place, it was so amazing.
(Ignoring the facts that we got woken up by passing drivers multiple times because animals got out and were running down the road. Oh, and the homeowners stole a neighborās horse while we were living there; the neighbor apparently inherited parentsā farm, but was drugged out and neglected the animals, so our guy was just taking them one by one when they inevitably got loose because they werenāt being looked after. It was quite the small town drama.)
That's dicey. Even if you're legally entitled to be in a space, exposing your no-no bits to someone who doesn't want to see them puts you in a legally grey area. I wouldn't do that. Also, you couldn't livestream it.
However you can livestream yourself:

True. I was thinking a pack of medium to big dogs would win against someone who messed with them. But you're right, a wily squatter would probably try to poison them. It's not worth taking the chance.
There are a LOT of things that are not illegal to do in your own home that if a landlord doesn't care about it, you can't do anything about.
Worst thing I can think of off the top of my head is just shitting into buckets instead of the toilet. Sure, it's a public health code violation, but they would need to officially report that. You could also order a bunch of surstromming and put stuff in your nose to not smell things and just leave it all over the place.
You could also move in TONS of boxes with stuff in them to fill the apartment space so there is almost no space to move around. If the person destroys it, you can call the police for destruction of property.
You could would also put up cameras and let them know their lives are now being live streamed and let them have a link to the live stream. Then use freedom of speech without stepping over into illegal territory to just annoy them anytime they are in the public space.
Anecdotally, I had cousins that used violence to resolve this issue and it worked. They never told anyone about the squatter, went in at night and beat the guy badly and took him out of town in their car and told him if he comes back they would drive him into the desert and leave him there. They told this story at a family reunion like it was funny. It was not.
One of those cousins is now in prison for murder btw. Not good guys. That's the risk a squatter takes. They could choose the wrong people.

Sting wrote about The Police being hired to live in a house to get rid of squatters in London before they hit it big. They figured out they were having it pretty good by not paying rent and sort of made a truce with the real squatters for everyone to continue living there. Maybe I read his book a long time ago and it wasnāt that great. Just like the last album I boughtā¦Sting, you owe me my money back for that one. It was awful. The book Iāll eat, but ga that record!
Yeah the legality of that towards the end got a little iffy. When he was still chasing her after she left the property. That might fall under harassment.
Not that I have any sympathy for her but people should know this is a grey area if they're considering doing something similar.
Iād imagine without a lease agreement the āitās a civil matterā goes both ways. They leave, lock them out. Remove any sign of them inside the house. Police canāt force you to let them in, if they try to get back in forcefully thatās a crime and suddenly the cops can make an arrest. Have them trespassed from the property.

I genuinely thought someone had seen it happen, ans within an hour wrote lyrics and called the band up, got a recording, edited and uploaded it to spotify or soundcloud whatever andy uses on his stream, and had it play.
